Blogging behind bars. "Before he sent me to the hole, the administrator looked at me and said, "You should have thought about this before you started playing games." I didn't start this journal to play any games, but now that we're playing, I'm determined to win."

I refused the breathalizer going on the advise of EVERY attorney I have ever spoken with.

Is this good advice? If he only had two beers and the machine actually works wouldn't he have passed?

Depends on the state he was in, how big he is (blood alcohol %), and whether he wanted his driver's license suspended.

It has always seemed to me to be good advice, since (my understanding is) if you pass, they can still tote you off to the pokey and you can't use the fact that you passed in court. They can still make you take a blood test. If you fail, off you go. No upside, only downside.

He definitely makes a good case for not drinking and driving. I like how he keeps his sense of humor throughout, and the link he provides to the Jail Products website should not go unmentioned.

Jparker: If you pass a Breathalyzer, of course you can use that in court. Defendant has the right to exculpatory evidence (that which points to innocence).

Two beers? Right.

That said, if I was snockered, I wouldn't blow either.

refusing to take a breathalyzer test can result in fines, license suspension, and jail time, according to what state you're pulled over in.

I refused the breathalizer. I was arrested. I went to court. I was sentenced to 55 days in jail.

The guy was pretty ignorant of the law. One would think that he would be a little bit more cautious the second time around, though. That said, he's a pretty good writer and I liked his stories. The site remind me of another site I saw a few years ago. It was about a guy who got busted for drugs and spent 200+ days in (medium-security?) prison.
