Is this good advice?  If he only had two beers and the machine actually works wouldn&apos;t he have passed?</description>

		<description>It has always seemed to me to be good advice, since (my understanding is) if you pass, they can still tote you off to the pokey and &lt;i&gt;you&lt;/i&gt; can&apos;t use the fact that you passed in court.  They can still make you take a blood test.  If you fail, off you go.  No upside, only downside.</description>

		<description>Jparker: If you pass a Breathalyzer, of course you can use that in court. Defendant has the right to exculpatory evidence (that which points to innocence).

		<description>The guy was pretty ignorant of the law.  One would think that he would be a little bit more cautious the second time around, though.  That said, he&apos;s a pretty good writer and I liked his stories.  The site remind me of another site I saw a few years ago.  It was about a guy who got busted for drugs and spent 200+ days in (medium-security?) prison.</description>
