I wonder if the artist could get away with this in Europe. I do believe (although understand I'm going from vague memory here, ie., I'm talking out of my ass a bit) that the original artist might still have "moral rights" to the work even after the sale, which might preclude any alteration without the original artist's consent. Yeah, but that clearly isn't a kraken, it's a giant creature from the black lagoon. I mean come on, not a single tentacle on that thing. Although I guess "Unleash the giant creature from the black lagoon" wouldn't be as catchy a title or have the pop-cultural cache.
