Religious Midwives abortion objection case due at UK Supreme Court

The UK's highest court is to be asked to rule on whether midwives have a right to refuse to take any part in abortion procedures on moral grounds. Appeal court judges in Scotland said last year that Roman Catholic midwives Mary Doogan and Concepta Wood had a right to conscientious objection. This was despite the pair not being actively involved in terminations.

It is worth noting that this case at this stage of appeal is not being run on religious freedom (Article 9 of the ECHR) grounds but on statutory interpretation grounds concerning how abortions are authorised and the scope of the Abortion Act 1967 conscientious objection exemption. I would say this substantially increases the chances that the appeal against the Inner House (appeal court) decision will be dismissed because it avoids a lot of the complications of the general balancing exercise. The Inner House decision is quite persuasive and I think they have a very good chance of winning.
