		<description>Being a Texan, I can only shake my head, but I&apos;m not surprised at all. I noticed that the article said &quot;wholesale promotion&quot; which is interesting because a number of RETAILERS in Dallas sell personal massagers which are quite obviously intended for different purposes. 

Still - I&apos;ve a hunch that the prosectutors are probably as embarrassed as the officers who stopped the car, and they&apos;re likely to just slap her on the wrist. There are a lot of double-standards in this state with regard to &quot;morality&quot; issues, and as soon as Texas would figure out a way to make the sex toy business generate revenue AND look acceptable to constituents, you can bet your Xandria account they will.</description>

		<description>i actually don&apos;t this is odd... as far as i know, lots of states have the same law... just like many states outlaw sodomy (which includes oral sex) like Texas, Georgia, and many others. (i dont feel like research right now).

Even if they are illegal, at least they are sold.  I&apos;m from Houston, and there is no code word...walk in a store and they are obviously dildos and vibrators of all sorts.

in oklahoma, tattoos are illegal (not to have) and there are NO tattoo parlors in the entire state.  how is that for america?</description>

Here in Georgia, they sell sex toys with the very visible disclaimer that they are sold as novelties only and are not intended for actual use.

Its not a Texas thing so much as a bible belt thing.

As for tattoos, they are illegal in South Carolina as well as Oklahoma.  In fact, everyone&apos;s favorite special prosecutor was recently &lt;a href=http://www.kentucky.com/mld/charlotte/news/breaking_news/4231796.htm&gt;rebuffed by the Supreme Court&lt;/a&gt; in an attempt to get the SC law overturned.</description>

If you try to turn this into some sort of conservative &quot;states&apos; rights!&quot; thread I&apos;ll mark you off as a troll forever.  It has nothing to do with the &quot;right&quot; of Texas to make their own laws.  It is a discussion of what many would consider to be an absurd law.  A felony for having vibrators?  Please.  

If you insist on derailing the thread then it will naturally progress into the hypocrisy of conservatives trying to keep the gov&apos;ment out of their business... unless it involves other people and their bedrooms, then by all means legislate away.

Where am I?  I thought this was a &lt;b&gt;dildo Texas&lt;/b&gt; thread.   If a state decides to ban rubber chickens and legalize whiskey and pistols, then so be it.  That is the beauty of the system in which we participate.

		<description>Gilbert: the gun remark was because I was comparing two things that are &lt;b&gt;somewhat &lt;/b&gt;unique to Texas, liberal gun laws (with open carry and often concealed carry completely legal, to my understanding) and very conservative decency laws.  I was legitimately surprised that Texas considers loaded guns in everyone&apos;s pocket to be &quot;safe&quot; and a couple of vibrators in a woman&apos;s car to be &quot;dangerous&quot;.

I also keep wanting to stress that it is a *FELONY*.  If it were a $20 misdemeanor it would still be ridiculous but not frightening.

I expected this out of Georgia, where apparently a blow job could theoretically send you to prison.  

Of course there are dumb laws where I live.  For instance, in my home town, you may only leave your horse stabled at the courthouse for a maximum of two hours.  There has likely not been a horse stabled at that courthouse since the 20&apos;s.</description>

Yes, every state has dumb laws, but the majority of those states are not actively attempting to enforce those laws.  When was the last time you heard of someone facing a two-year prison sentence for wearing slippers after 10:00pm?</description>

I knew a co-worker that was arrested repeatedly on her former job for selling dildos.
She was a college student at the time working a crappy part-time job.
Other states might have wacky laws on the books, but can you point out where anyone has been arrested, prosecuted and fined for wearing slippers after 10 pm?

		<description>2Sheets: Was your friend prosecuted? It only takes one cop to arrest someone. If a DA brought the force of state law on her, that would be another thing, but I bet that never happened.&lt;br&gt;
This woman was pulled over for a suspected DWI. She (presumably) refused the field sobriety test, so the cops found something in her car they could arrest her for. It could have been a seat belt violation, but it wasn&apos;t. It was the too many dildos law.&lt;br&gt;
Of course it&apos;s a dumb law. But it doesn&apos;t get prosecuted. And it says absolutely nothing larger about the state in which it happened.</description>

She told me about it after the fact, and mentioned that her boss would pay the fines. I didn&apos;t get a lot of details, but she said that she had misdemeanors on her rap sheet because of it and didn&apos;t realize how serious that could be down the road.
I wish I could tell her name, because it was a great pun relevant to the situation, but of course I will respect what&apos;s left of her privacy.
She said the Austin paper had fun with it, though.</description>

I won&apos;t deny that Texas has a heaping dose of far right wing, close-minded idiots - but we have a nice balancing share of marshmallow-headed, knee-jerk left wingers too. And lots and lots of folks peppered all over the spectrum between.</description>

It&apos;s not a state&apos;s rights issue.  A state cannot have rights.  Only human beings have rights, endowed by their creator.  And no human being can in good conscience take away the rights of others.  People have fought and died over stupid laws like this.

It may be a relatively benign tyranny, but that is what Texas is.  I don&apos;t personally own a dildo, but I would fight and die for your right to own as many as you want.</description>

Wrong, wrong and wrong. Human beings have no creator-given rights. There is no conclusive evidence that a creator even exists. That word is in the Consitution because Jefferson was a god-fearing man and liked to wax rhapsodic. But the reality is, rights are political creations and are extended to each other by each other, as part of a social contract. &lt;i&gt;We &lt;/i&gt;give &lt;i&gt;each other &lt;/i&gt;rights, in exchange for certain responsibilities. Which leads to your second wrong: humans can (and do every day) take away other humans&apos; rights, primarily when the latter bunch abrogate their responsibilities (like, when they commit crimes). Lastly, people have never and will never fight and die over stupid laws like this. People will fight and die over women, money, the Flag, God, Country, honor, glory,cowardice, ad infinitum. But no one in their right mind who understands what the hell they are doing is going to voluntarily face death over the Texas Dildo Law. Even you. You know why? Because it&apos;s just too totally stupid to do so. You might say you would - you might even *believe* you would. But there is no one on this green earth that would actually forfeit their life to defend the &quot;right&quot; of Texans to own and/or sell more than six dildoes.</description>

I spoke with the salesgirl at the local Condoms to Go here in Dallas a while back and here&apos;s the scoop, as it were. In order for it to be legal, every package has to have a warning. Something to the effect of &quot;This is not for genital use.&quot; She doesn&apos;t sell dildos, she sells massagers. 

And that&apos;s basically all there is to it. It&apos;s a sex toy shop. No doubt about it. But as long as the word is not spoken and the stickers are in place, it&apos;s not illegal. 

Whoever likened it to a headshop where you buy a &quot;water pipe&quot; was dead on.</description>

This &quot;social contract&quot; business is slave talk.  It is not a &quot;privilege&quot; to drive, vote, travel, or own property.  Anything the government does to limit your freedom is an abridgement of your natural rights.  We may swallow hard and learn to live with it, but at some point it can go too far.</description>
