Being a Texan, I can only shake my head, but I'm not surprised at all. I noticed that the article said "wholesale promotion" which is interesting because a number of RETAILERS in Dallas sell personal massagers which are quite obviously intended for different purposes. Still - I've a hunch that the prosectutors are probably as embarrassed as the officers who stopped the car, and they're likely to just slap her on the wrist. There are a lot of double-standards in this state with regard to "morality" issues, and as soon as Texas would figure out a way to make the sex toy business generate revenue AND look acceptable to constituents, you can bet your Xandria account they will.

i actually don't this is odd... as far as i know, lots of states have the same law... just like many states outlaw sodomy (which includes oral sex) like Texas, Georgia, and many others. (i dont feel like research right now). Even if they are illegal, at least they are sold. I'm from Houston, and there is no code word...walk in a store and they are obviously dildos and vibrators of all sorts. in oklahoma, tattoos are illegal (not to have) and there are NO tattoo parlors in the entire state. how is that for america?

Here is some more info about Georgia and Alabama's bans on sex toys, with more links in the article (note the appropriate use of an apostrophe to denote a possesive). Here in Georgia, they sell sex toys with the very visible disclaimer that they are sold as novelties only and are not intended for actual use. Its not a Texas thing so much as a bible belt thing. As for tattoos, they are illegal in South Carolina as well as Oklahoma. In fact, everyone's favorite special prosecutor was recently rebuffed by the Supreme Court in an attempt to get the SC law overturned.

Texas is like a whole other country. That's how it's supposed to be. Read up on the U.S. Constitution sometime, and you'll probably come to the surprising conclusion that the "United States of America" was never intended to be a plain vanilla, homogeneous country. Texas is a "state" (a term often used to describe sovereign nations), and the "United States" is a union of those semi-sovereign states, not just a clever name for a big country divided into 50 provinces.

Yep, Gilbert, dumb laws seem to be for everyone. For instance, in New York state, you can't wear slippers after 10 p.m.; in California it is a misdemeanor to shoot at any kind of game from a moving vehicle, unless the target is a whale.; and in Pennsylvania you are not allowed to sing in the bathtub. In fact, you'd be hard pressed to find a state that didn't have a few head scratchers on the books. Or is it just that those states are as ass-backwards as some of you perceive Texas to be? Gilbert: the gun remark was because I was comparing two things that are somewhat unique to Texas, liberal gun laws (with open carry and often concealed carry completely legal, to my understanding) and very conservative decency laws. I was legitimately surprised that Texas considers loaded guns in everyone's pocket to be "safe" and a couple of vibrators in a woman's car to be "dangerous". I also keep wanting to stress that it is a *FELONY*. If it were a $20 misdemeanor it would still be ridiculous but not frightening. I expected this out of Georgia, where apparently a blow job could theoretically send you to prison. Of course there are dumb laws where I live. For instance, in my home town, you may only leave your horse stabled at the courthouse for a maximum of two hours. There has likely not been a horse stabled at that courthouse since the 20's.

'cuz Jebus and Sam Walton don't approve, apparently. on the anti-TX tip, ease up folks, most states have some nice archaic morality laws on the books. we here in the Commonwealth of Massachusetts had an interesting case last year where two cops searching a warehouse for stolen steros came upon an underground S&M club, and arrested a woman for spanking another woman with a wooden spoon. also the "host" of the party was charged with possession of naughty materials, i.e. dildoes, vibrators, sex swings, etc. this took place in Attleboro, MA, thus the affair became "Paddleboro"! incidentally, the charges were reduced and dropped and there was massive outcry for the fuzz to leave consenting adults alone. hmmm, i guess that's not such a Texas-solidarity story after all...

2Sheets: Was your friend prosecuted? It only takes one cop to arrest someone. If a DA brought the force of state law on her, that would be another thing, but I bet that never happened.
This woman was pulled over for a suspected DWI. She (presumably) refused the field sobriety test, so the cops found something in her car they could arrest her for. It could have been a seat belt violation, but it wasn't. It was the too many dildos law.
Of course it's a dumb law. But it doesn't get prosecuted. And it says absolutely nothing larger about the state in which it happened.

The store owner, Robert Duggan III, was never arrested, but he agreed to plead guilty to a misdemeanor count of obscene display, a charge equivalent to a traffic ticket, and agreed to pay a fine and let police destroy the items. SURE they destroyed the items, just like I'm sure the cops that pulled me over "destroyed" that full, unopened bottle of tequila they confiscated.

An actual answer, as if anyone cares: I spoke with the salesgirl at the local Condoms to Go here in Dallas a while back and here's the scoop, as it were. In order for it to be legal, every package has to have a warning. Something to the effect of "This is not for genital use." She doesn't sell dildos, she sells massagers. And that's basically all there is to it. It's a sex toy shop. No doubt about it. But as long as the word is not spoken and the stickers are in place, it's not illegal. Whoever likened it to a headshop where you buy a "water pipe" was dead on.

smallberries, I lived in Texas for 12 years, and knew a pretty wide spectrum of folks as you point out. I'd say after that much time, and time spent living on both coasts, I'm entitled to my opinion about Texas as a whole. I don't give a damn what's in the Constitution. I'm talking about moral principle here. And, yes, I would die fighting for the right to own six dildoes, even though you are not willing to fight for your own rights. I would have to be pushed against the wall -- I'm not saying "I will commit suicide if they don't stop outlawing dildo sales." I am saying "I am going to do whatever the hell myself and God think is okay, and if you try to stop me you'll have hell to pay." Put another way -- if we were all forced to live under the same conditions as a kindergarten class, a benign sort of tyranny, some of us would eventually stage violent revolution. I would probably have slit the teacher's throat by now. A man who "gives his rights away" is a slave. A man who has "responsibilities" to other men, other than simply leaving them alone, is a slave. A man who takes away the rights of others is a tyrant, and tyrants must be opposed for the good of all men who may be slaves. This "social contract" business is slave talk. It is not a "privilege" to drive, vote, travel, or own property. Anything the government does to limit your freedom is an abridgement of your natural rights. We may swallow hard and learn to live with it, but at some point it can go too far.
