The United States Supreme Court weasels out of making a decision one way or the other in Elk Grove Unified School District v. Newdow.
In a unanimous decision (Justice Scalia having recused himself) the Supreme Court found that atheist Michael Newdow could not sue to ban the pledge from his daughter's school and others because he does not have sufficient custody of the child to qualify as her legal representative.

I tend not to think of unanimous decisions as "weasling". It probably had something to do with, like, y'know, the law or something. But I'm disappointed that we didn't get a decision.
