Sony Backs Down on Copy Protection Software

Sony finally decides to protect consumers from 'copy protect software'. The software became an issue a few days ago due to a trojan horse exploit. Was this type of attack made possible due to the fact that protection installs without permission and is not even visible to the average user? Is the whole notion of copy protection software misguided?
