I have to say that I suspect the police and prosecutor use these tactics all the time, and the only reason she got any kind of sympathy for them at the trial was because she was a young white female honor student with a good lawyer. A male in the exact same circumstances would probably already be on death row.

Hating your mother isn't a crime but at the very least, creating a false alibi for an admitted murderer must be. The mistake was the prosecution going for first degree.

The post is misleading. She is not free by any means yet. She is now merely eligible for lower bail. She may still be retried from what was linked in the story on the word "free".

If the two boyfriends testify against her, and if there are things like computer chat records or similar, this could still be quite a damaging case and a prison sentence for this girl.

Because the remaining evidence, minus Waterman's statements, may still be enough for another grand jury to return another indictment, the judge didn't free Waterman outright. She did, however, reduce bail from $150,000 to $50,000.

The computer chat records have been examined and revealed nothing incriminating. The strongest evidence was in the confessions which are now inadmissible. The testimony of the two boyfriends who have an incentive to cooperate because of plea agreements are likely to amount to nothing.

She is as good as free on these charges.

Whether she did it or not, the police have a bad habit of overstepping the bounds of the law. They are the ones who ruined this case. It's their own damn fault.

Critical mail exchange -

Arrant : "I'll be so glad when this whole thing with your mom is over. I know it's not like I'm gong to be able to see you right away probably, but at least you will be safe,"

Waterman : "It will happen one day, hopefully not long after vball"

Arrant interprets this as Waterman's signal to kill her mother. But in the next paragraph ...

Waterman : "I talked to (mom) about you and our night that we sat at the ball park and how we decided way back around when school started just to be friends. Hopefully, after volleyball you could come over and just watch a movie,"

chief: "They must have been in cahoots! Arrest the girl, too! And the grandparents! And I don't like the looks of that dog... his eyes are shifty."

I think it may be more like "I don't really want you to kill her but you know.... sex with you was soooooo good and I think about being with you aaaaaall the time and it's suuuuch a shame she won't let me be with you. And here are a few pornographic pictures of me in case you don't believe me. Oh ... but if you do do it , which I don't want you to really, I will create a false alibi for you , k?"

Is it enough without a confession? Almost certainly not.

Perhaps. We've got quite a who-dunnit going on in the Albany, NY area -- the Porco case. It's definitely a candidate for one of the Law & Order shows at some point.

Here's a nice article that's only the tip of the iceberg as far as this twisted saga goes. And once again, the police may have gotten a little footloose and fancyfree with the law. Though, the Porco kid has some explaining to do too. And he's got one of the top criminal defense lawyers in the area. It should be interesting.

My friend Jed was good friends with this girl (He's from southeastern alaska) and thay've been sending letters back and forth between her in jail, and him here at school.

Apparantly, the girl was not on good terms with her mother, what with her dating these douchebags. She would complain about her mom (as all teenage girls are wont to do) and the boys took this as a signal that they should kill her mom.
