Prop. 8 lawsuit

Gay rights groups filed the first prop. 8 lawsuit today alleging that it's an illegal revision of the California Constitution. They've asked the gay couples in the state continue to be allowed to marry while the court makes its decision. Official results are still out, though most news outlets have already said the proposition has passed. Stil, the no side isn't willing to concede they've lost because they believe millions of votes--many which could be from their core of younger voters--have yet to be counted.

Despite Justice Kennedy's efforts to craft around this result, I think that Romer v. Evans holds more precedential value than it would seem to at first glance.

I'm surprised that California allows the state constitution to be amended on a simple majority- it seems like something as important as taking away a despised minority's rights should have a higher hurdle.

Well, if this lawsuit offers a way to do an end run around the bigots and shut this hate legislation down, this hetero married breeder is all for it. There is no place in America for any law supporting discrimination against other Americans.

Yes. It's completely batshitinsane. The California Constitution is eleventyzillion pages long. The process to amend it is stupidly easy.

I find it difficult to believe that he State Constitution can be revised to strip people of rights that other people are allowed.

Prop 8 will fail. It will likely take years and a fuck-ton of money, but it will fail.
