If you break it, you bloody well fix it.

Coming from a place where some of those 300 prisoners may be returned, I would say those that are tried fairy and found innocent, ought to be compensated monetarily and by being given US residence or citizenship, based on the following principle: if you break something, you fix it. The innocent people who were picked up and sent to Gitmo are damaged goods, having been sexually assaulted, water-boarded and lord knows what else. The society that must bear the cost of rehabilitating them, and bear the risk of them going postal, is the the society that rendered them such.

With respect to those who are found to have been enemy combatants for Al-Qaeda or the Taliban in the strict sense defined in the article, Mr. Cole's prescription is fairly reasonable. Eric Posner's, conversely, makes little sense and indulges in thinly-veiled, but not rationally supported, anti-Islamism (Islamophobia, makes it sound as though the prejudice/fear is legit).

Cole chooses to ignores the essential fact. The United States *is not* at War.

Only Congress can declare War. Congress has not declared War. Therefore the suggestion that extraordinary Wartime measures are somehow required is laughable.

Or would be if the deprivation of Due Process and Equal Protection hasn't been denied to hundreds if not thousands of people.

The idea of giving sociopaths a playground dungeon to torture in has always disturbed me. I mean, even if you can handwave away the ineffectiveness and immorality of torture, do you really want to work in an organization that employs torturers? Do you want those torturers retiring from military life into your community? Interacting with your friends and loved ones?
