When you say "contractor" do you mean he's a guy that does construction, or do you mean that he is licensed and bonded by your state?
If the latter is correct, contact the state licensing board and try to recover against his bond.

the merchant gets fraud protection? that's news to me. the only fraud protection is for the cardholder, not the merchant.
I don't think the CC company is going to rule in the merchant's favor if the card was REPORTED STOLEN. the merchant is the victim, the fraud protection is for the customer who got their card stolen.

If you don't know... I would suggest going transactional. Besides, all of this is speculation until you start to get to look at offers.

if any lawyer wants you to be responsible for the case costs, run far, far away.
quick note about future damages, they are going to get "periodicized" and essentially reduced to present cash value.
finally if you don't have substantial, permanent or debilitating injuries, you're not going to get far. in CA, for example, any judgment against a doctor for malpractice for $50k [or about] is reported to the state medical board.... [more]

Doctors aren't God... although they act like they are [sorry ;p]. They make mistakes, they're not perfect. And that's exactly what their lawyer is going to tell the jury... and he's RIGHT... on what the law says anyways.
The operative, excuse the pun, question is going to be whether or not the treatment was "outside the standard of care". That can be a complex question, especially when the issue is how a particular surgery "healed up".... [more]
