Who says DeCSS litigation is dead? Norwegian court indicts the fellow who cracked DVD protection.

Don't take indictment as necessarily pro-DMCA or pro-RIAA. Indictment does not equal conviction. An indictment followed by an acquittal would do more do damage the effectiveness of DMCA-like laws than no indictment at all. Legal strategists know this, which is why, for example, some people intentionally try to get indicted for violation of sodomy laws, so that their acquittals will effectively kill those laws.

So without the indictment, the laws cannot be challenged.
