Recipients of "Leaks" May Be Prosecuted, Court Rules In a momentous expansion of the government's authority to regulate public disclosure of national security information, a federal court ruled that even private citizens who do not hold security clearances can be prosecuted for unauthorized receipt and disclosure of classified information. The ruling by Judge T.S. Ellis, III, denied a motion to dismiss the case of two former employees of the American Israel Public Affairs Committee (AIPAC) who were charged under the Espionage Act with illegally receiving and transmitting classified information. The decision is a major interpretation of the Espionage Act with implications that extend far beyond this particular case. The Judge ruled that any First Amendment concerns regarding freedom of speech involving national defense information can be superseded by national security considerations.

George Bush is exempt from the parts of the much reviled Patriot Act that he doesn't like -- by decree of George Bush. He signed the bill with pomp and circumstance. But after the reporters and guests went home, he issued a "signing statement" that he can withhold information from Congress in violation of the law.

Senate Blocks Patriot Act Renewal In a 52-47 vote, the Republican majority was unable to obtain the 60 votes necessary to end the bipartisan fillibuster. Roll call is in the title link as well as here, Patriot Act provisions set to expire on 12/31 via CNN.

Patriot Act used to arrest environmental activists
"Federal marshals arrested six environmental activists in a series of coordinated raids in four states yesterday, Dec. 8, in apparent response to a string of arsons in Oregon and Washington attributed to the Earth Liberation Front (ELF)" ... has the patriot act produced any arrests in the country related to 9-11?

CEO of eBay's Indian company arrested for an item offered up for sale on his site. Avnish Bajaj, the CEO of baazee.com, an Indian auction site purchased by eBay in June 2004, was arrested on Friday while assisting in the investigation into the attempted sale of pornography by a user on the auction site, and charged with violating the 2000 India IT Act. Bajaj was arrested even though he was not involved in the sale, had it cancelled as soon as it was found, and the people involved had already been arrested.

Who Lost Ohio? As more evidence comes in disproving voting fraud in the 2004 Presidential election, perhaps the real lessons for Democrats can be gleaned from this NYT (Reg required, of course) feature on ACT, a Democratic 527. Lavishly funded by George Soros and unions, this high tech organization turned out a record number (2.66 million) of Democratic voters in Ohio, but were out-organized and beaten by a grass-roots Republican effort operating below their radar. "Ashcroft dismissed the idea that the Justice Department could conceivably care about librarians or library records... [however,] a University of Illinois study... found that by February of 2002 (four months after the Patriot Act was passed) 4 percent of all U.S. libraries, and 11 percent of all libraries in communities of more than 50,000 people had already been visited by FBI agents requesting information about their patrons' reading habits." This is some scary stuff. Life in prison for malicious hacking? We can't keep rapists and murderers away from society for very long but now hackers & crackers could be jailed for life? And on top of that the FBI can monitor internet packets without a warrant? If you enjoy your freedom from gov't surveillance, it looks like it's time to start using PGP.
