The Gift to Humanity That Keeps on Giving to Lawyers

The Authors Guild, the Australian Society of Authors, the Union Des Écrivaines et des Écrivains Québécois (UNEQ) along with 8 individual authors (including Fay Weldon) has sued the university consortium HathiTrust over its plans to allow internal institutional access to book scans that HathiTrust members received from Google which HathiTrust believes to be orphaned works. Opting out rejected, Opting in suggested

Only weeks after Judge Denny Chin extended the filing deadline, and presumably a final decision, and reflecting the Department of Justice’s own opinion, the 2nd Circuit Court of Appeals has rejected the landmark class-action lawsuit settlement between the Authors Guild, the Association of American Publishers, and Google. And offers some advice for a revised resubmission.

The Amended Settlement filed in Authors Guild v. Google creates a non-profit Book Rights Registry governed by authors and publishers to oversee the settlement on their behalf. A Fairness Hearing has been scheduled for February 18, 2010; authors have until January 28, 2010 to opt out of the agreement. The SFWA is objecting to (among other things) Google's potential monopoly, to the opt-out clause, and to leaving the fair use dispute (pdf) unresolved. The ALA, ARL and ACRL have some similar concerns (pdf) and have released a Guide for the Perplexed (pdf). The NWU opposes it; so does the ASJA. (previously, previously).

Authors Guild seeks to stop Amazon from selling used books. It's the analog version of RIAA vs. Napster!

"Amazon's practice does damage to the publishing industry, decreasing royalty payments to authors and profits to publishers. In time, as we pointed out to Amazon CEO Jeff Bezos when it first began this practice over a year ago, the financial loss to the industry could affect the quality and diversity of literature made available through booksellers. If profits suffer, publishers will cut their investments in new works, and authors facing reduced advances and royalties will have to find other ways to earn income. "
