"We Don't Want You Here"

The number of refugees from Iraq and Afghanistan seeking asylum in Europe continues to grow. Recently, despite criticism from the UN, deportations have begun. Most of those on a recent flight to Iraq were forced to return to the UK (the nationalities of some remains unclear, as does their fate). Furthermore, the move to deport has meant denying that Iraq and Afghanistan are each in a state of war.

Thin ICE

"ICE does not keep records on cases in which detainees claim to be US citizens. If larger trends are consistent with the pattern in Hartzler's caseload, since 2004 ICE has held between 3,500 and 10,000 US citizens in detention facilities and deported about half. US citizens are a small percentage of ICE detentions for this period, which totaled around 1 million, but in absolute terms the figure is staggering. "

Interpreting Due Process

An Interpreter Speaking Up for Migrants: Erik Camayd-Freixas is a professor and a legal translator who assisted in the fast-track trial and sentencing of the over 400 illegal immigrant workers in Postville, Iowa, who were arrested on criminal charges involving identity theft rather than the usual deportation proceedings. Unusually for a court interpreter, who maintain a strict code of impartiality and neutrality, Camayd-Freixas spoke out, writing "that the immigrant defendants whose words he translated, most of them villagers from Guatemala, did not fully understand the criminal charges they were facing or the rights most of them had waived." The Times article has a video interview with Camayd-Freixas.

His 14-page essay can be read here (pdf). It is vividly-written:

He stared for a while at the signature page pretending to read it, although I knew he was actually praying for guidance and protection. Before he signed with a scribble, he said: “God knows you are just doing your job to support your families, and that job is to keep me from supporting mine.” There was my conflict of interest, well put by a weeping, illiterate man.

Adding an additional layer of ethical complication is that many of the workers were Mayan Indians from Guatamala -- the people who were victims of a massive genocide in the 1980s.

More idiocy from the British Home Office

Article in UK newspaper The Independent about two members of Nottingham University, U.K., Rizwaan Sabir and Hicham Yezza, who were arrested last week on terrorism charges and held for six days before being released without charge. The reason was that they had downloaded a terrorist manual from a US government website, which MA student Sabir needed for his research into terrorism, and which was approved by his supervisor. His friend Hicham Yezza, former student and current administrator at the university was arrested for helping to print out the 1500 page document. On release Yezza was then immediately rearrested on immigration charges and now faces imminent deportation, despite being a resident of the UK for 13 years and currently in the process of applying for citizenship. A campaign is currently underway to prevent this. Also see articles in the Guardian and the Herald Tribune. There's even a facebook society page about it.

The U.S. government has injected hundreds of foreigners it has deported with dangerous psychotropic drugs against their will to keep them sedated during the trip back to their home country "The government's forced use of antipsychotic drugs, in people who have no history of mental illness, includes dozens of cases in which the "pre-flight cocktail," as a document calls it, had such a potent effect that federal guards needed a wheelchair to move the slumped deportee onto an airplane."

Now the Musicologists Are Dangerous Too

"Dr. Nalini Ghuman {is} . . . a citizen of the United Kingdom and a professor of music at Mills College in Oakland, California. In August 2006 Dr. Ghuman was detained upon her return to the United States."
And nobody knows why. The American Musicological Society and Mills College are working the case, in a rather rare show of political activism from one of the more monastic corners of academia. Her faculty bio says she's on leave (and her CV is still there, if you want to be impressed). Jonathan Bellman has thoughts on the matter. By all accounts, she is "a passionate advocate of classical music as part of a liberal arts education" (from the Mills College statement quoted on the AMS site linked above.) A South Asian who grew up in Wales and speaks Welsh, Prof. Ghuman's case represents a terrifying sign of the new reality for professional foreign nationals who work in the US today, including many academics. The USA is starting to resemble another country in this respect. Condi Rice has no comment.

The nationalist Swiss People's Party (who garnered 26% of the vote in the last elections) is proposing a deportation policy reminiscent of Nazi-era practices. Under the plan, entire families would be expelled if their children are convicted of a violent crime, drug offense or benefits fraud. And get a load of their black sheep poster campaign, or their 2004 poster, with the dreaded black hand reaching for (gasp!) a Swiss passport. If a permanent resident doesn't file this change-in-address form, they are talking about penalties up to and including deportion! Note we aren't talking about student visa holders or anything like that .. we are talking about people who have lived in this country for 10 .. 20 .. 30 years or more in many cases.

This country is really turning into a police state the way things are going.

According to the US State Department's website, New Zealand citizen Mohammed Saffi was not in violation of his visa when intending to attend a Miami flight school for 727 aircraft engineering certification.

At least that's what NZ Green Party foreign affairs spokesman Keith Locke says.

Great article on how gang deportees go back to their old countries much deadlier than before they left. Reminds me of the prison is a "criminal college" argument.

The Latest Michael Moore message is about the INS trying to deport 8 hotel workers. The workers were arrested in a raid, thanks in part to their employers tipping the INS off, in retaliation for the workers starting a union. Even though they won a court battle over Holiday Inn's unjust labor actions, the INS is still after them. Is this fair?
