Eyewitness tell a different story. Whatever happened the killing has prompted demonstrations and looting. Ferguson police responded in full force, firing teargas and wooden rounds into crowds of protestors and sealing the area off from the media. In the wake of the tragedy questions of racial profiling, the paramilitarization of police and media depictions of black shooting victims have been raised. The Supreme Court heard arguments yesterday in Rumsfeld v. FAIR, a case challenging the Solomon Amendment, a US federal law that allows the government to cut federal funding to universities that refuse to allow military recruiting on campus. FAIR is a coalition of law schools challenging this law on the basis that the US military's policy of prohibiting open homosexuals from serving violates the schools' anti-discrimination policies (see section 6-3). Summing the issue up nicely, the dean of one law school said of the US military, "If it were a private employer who discriminated on the basis of sexual orientation, race or gender, we wouldn't allow them here on campus." .rm C-SPAN coverage here.
Every gay and lesbian federal employee has just lost their protection from discrimination. Gay and lesbians in the entire federal workforce have had their job protections officially removed by the office of Special Counsel. The new Special Counsel, Scott Bloch, says his interpretation of a 1978 law intended to protect employees and job applicants from adverse personnel actions is that gay and lesbian workers are not covered. Bloch said that the while a gay employee would have no recourse for being fired or demoted for being gay, that same worker could not be fired for attending a gay Pride event.
