Ho[over]! Ho[over]!Ho[over]!
According to a document that was one of many declassified [PDF] by The State Department yesterday, “Former FBI Director J. Edgar Hoover had a plan to suspend the rules against illegal detention and arrest up to 12,000 Americans he suspected of being disloyal....The plan called for the FBI to apprehend all potentially dangerous individuals whose names were on a list Hoover had been compiling for years. ‘The index now contains approximately twelve thousand individuals, of which approximately ninety-seven percent are citizens of the United States,’ Hoover wrote in the now-declassified document. ‘In order to make effective these apprehensions, the proclamation suspends the writ of habeas corpus.’” [habeas corpus previously -- 1, 2, 3, 4, 5.]

"Guantanamo Unclassified." Adel Hamad, a 48-year-old Sudanese elementary-school teacher, has been held at Guantanamo for five years without charge or evidence of a crime. His lawyers have been unable to convince a federal court to review his case, so they started started Project Hamad and posted a short movie about him online. This is an example of how human rights activists can use YouTube to bring their cases to the public.

Habeas Corpus, R.I.P. (1215 - 2006). It was so pre-9/11 anyway. Instead we may get "our generation’s version of the Alien and Sedition Acts." What could go wrong?

"The power of the Executive to cast a man into prison without formulating any charge known to the law, and particularly to deny him the judgement of his peers...is the foundation of totalitarianism" Perhaps Tony Blair and George W. Bush regard Winston Churchill as a bleeding heart lefty. But what Churchill's view represents is an old, very basic principle of Anglo-American warfare and justice: fight war with ferocity, but never lose your democratic soul.

Methamphetamine is now a WMD. Well, I guess we should've seen it coming. According to this Salon article, prosecutors across the country are now using the Patriot act to prosecute drug crimes, fraud, and anything involving a bomb. This means any of these people may be detained indefinitely without an attorney. I don't like trailing questions, but I would like to see some constructive and creative posts about what can be done to protest this. It's so blatantly unconstitutional, it's not funny anymore, and I for one am not willing to welcome our new overlords.

Reno blocks release of Palestinian man held without charges. Janet is gonna get a nasty reputation for locking up people "for national security reasons" without charging them with anything.
