Cloture to force a vote on the fiscal 2011 defense authorization bill has not been achieved. DADT will stand. Chances are not better in a possibly more Republican Senate post-November, and the bill is unlikely to pass before then. Republican voters against cloture: Every single senator; Democratic voters against cloture: Blanche Lincoln and Mark Pryor.

The Supreme Court heard arguments yesterday in Rumsfeld v. FAIR, a case challenging the Solomon Amendment, a US federal law that allows the government to cut federal funding to universities that refuse to allow military recruiting on campus. FAIR is a coalition of law schools challenging this law on the basis that the US military's policy of prohibiting open homosexuals from serving violates the schools' anti-discrimination policies (see section 6-3). Summing the issue up nicely, the dean of one law school said of the US military, "If it were a private employer who discriminated on the basis of sexual orientation, race or gender, we wouldn't allow them here on campus." .rm C-SPAN coverage here.

One of the more interesting Senate races in 2004 is shaping up in Florida, where everyone but the electorate appears to know that Republican U.S. Rep. Mark Foley is gay. This open secret -- which would help explain how a "dream come true" right-wing politician has a strong gay-rights voting record -- calls into question whether respecting a person's right to "stay in the closet" perpetuates the idea that homosexuality is abnormal. The Supreme Court is currently hearing arguments about the constitutionality of homosexual sex. While this may not be news, just listening to some of the comments by the conservatives on the court can be a chilling experience, whether you are straight or gay. Is it possible that there can be supreme court justices, supposedly the best of the best, who are really this ignorant?

On September 17, 1998, in response to an armed robbery call, Houston police burst in to the home of John Lawrence. The police didn’t find a robber (nor would they – the call was deliberately false), but they did find Lawrence having sex with another man, Tyrone Garner. Lawrence and Garner were promptly charged with “engaging in homosexual conduct,” a misdemeanor under Texas law. They paid their fine and began a long legal challenge to Texas’ anti-sodomy law. That challenge has finally reached the steps of the U.S. Supreme Court, which today agreed to hear their appeal early next year. Standing in the way is the Court’s own 1986 decision in Bowers v. Hardwick, in which it held that anti-sodomy laws are constitutional. That may be about to change.

Gay, lesbian troops can serve openly -- for now "First, gays and lesbians would be allowed to serve during any war, just as they do now, as long as they remain in compliance with the homosexual conduct policy," said Maj. James P. Cassella of the assistant secretary of defense for public affairs' office."

Sorry we've treated you so crappy, but, uh, we need you to serve now. Of course, when we don't need you any more, you'll be discharged because you're gay.

Senate passes amendment withholding money from schools that deny use of their facilities to the Boy Scouts on the grounds of their exclusion of homosexuals. Says Jesse Helms, sponsor of the amendment to Bush's education bill, this is meant to combat "the organized lesbians and homosexuals in this country of ours." Is this justified in light of the Supreme Court's ruling that the Scouts have the right to exclude whomever they wish, or just flat out anti-homosexual?

Anti-bullying vote blocked by Christian Conservatives The Washington State bill would have required school districts to set up policies against harassment, bullying and intimidation. Christian conservatives that blocked the vote claim "it amounted to censorship of their right to condemn homosexuality." There is no mention of homosexuality in the bill at all. So this leads me to the conclusion that these Christians condone "harassment, bullying and intimidation." How far from the Golden Rule can you stray and keep a straight face?

Television stations in New York are refusing to run ads questioning Hillary Clinton's sexuality: "The ads were prepared by the Virginia based Christian Action Network. The 30-second TV ad features pictures of Hillary Rodham Clinton with the following narration: "It is rumored that Hillary Clinton is a lesbian. It is rumored that Hillary Clinton supports homosexual marriage. It is rumored that Hillary Clinton will leave her husband upon taking office. It was rumored that Bill Clinton had an affair with Monica Lewinsky. Sometimes rumors are true." The narrator then says to contact CAN for 'more information on traditional family values.'" whoa, that is so classy! way to go, christian action network!
