Michael Schmidt has been found
not guilty of selling raw milk in the province of Ontario. Schmidt owns a
dairy co-op where consumers can purchase shares in a dairy herd and receive a portion of the
raw milk those cows produce in return. His farm was
raided and his equipment seized at gun point back in 2006. Experts are predicting this decision could have wide ranging effects on the rights of consumers to choose what they purchase and eat.

Gay Marriage - Go Canada Canada is only the third country, after Netherlands and Belgium, to legalize gay marriages. This surprised me because I figured we were playing catch up to most 1st world countries. Not so surprisingly my home province of
Alberta is promising to block same sex marriages and will refuse to issue licenses to same sex couples. Which must be putting smiles on faces at
Tourism BC. Interestingly this may cause big waves in the USA as they have traditionally recognized Canadian marriages as valid under US law and Canada has no
residency requirement for marriage licenses. How surprised would you be if your local authority followed Canada’s example?

Monsanto wins case against Canadian farmer.
Percy Schmeiser, who has attained folk-hero status, was held liable for growing genetically modified canola without paying the royalty. The decision in a federal court in Saskatoon, Saskatchewan, was a significant setback for farmers who fear they will be held liable if pollen from neighboring farms blows onto their fields, transmitting patented genes to their crops without their knowledge or consent.

Who owns your name? I could not find this story on the web. I saw it in print. It appeared in an article by Geoffrey Vanderburg in the Friday Sept. 29th Edmonton Journal.
Here's an excerpt.
"An internet company with links to the National Firearms Association has been ordered to give up a Web site using Justice Minister Anne McLellan's name. Smartcanuk Internet Services has been told to transfer control of annemclellan.com to Canada's justice minister, McLellan's Edmonton lawyer said Thursday"
Al Green, owner of Smartcanuk... says the ruling sets a "very very dangerous precedent."
"Sandra Sellers, an eResolution arbitrator...., decided Monday to grant transfer of annemclellan.com and annemclellan.org to McLellan."
McLellan was able to demonstrate that the domain name was identical or similar to a trade-mark, that Green had no legitimate interests in the name, and that the name was being used in bad faith....
Green argues McLellan is not a trademark, she's not famous and his use of the Web site does not constitute "bad faith"
I think I have to agree with the arbitrator on this one. If there is one last sacred domain we should be entitled to it is our own names. Although in the case of the John Smiths of the world that position is likely to take some heat. Any thoughts people?

Man, I love Ontario. Monday afternoon, an amazingly significant court trial ruled that possession of marijuana being criminal is unconstitutional, and that new laws need to be written.

Now this is something you don't see everyday. There's this
small Canadian airline that has an
interesting legal disclaimer you see right before you start ordering a ticket. Scroll down to the paragraph that starts 'PERSONS WITH SPECIAL NEEDS' which includes some compassionate nuggets like 'The WestJet® Web Site is not designed for use by persons with special needs.' What a warm, caring bunch of folks, eh?
