Napster sued for putting people to sleep. Yep. A company that produces meditation music is taking Napster to court so they're not responsible for the effect of their music when downloaded, without the warning label.
(via Short News)
Yep.

What is being shared on Napster and company? Let's just say p2p isn't helping to promote your garage band like some would claim.

Charley Pride's Copy-protected CD hacked -- or is it? Apparently, the people involved in trying to keep the CD off Napster failed to realize they are dealing with the World Wide Web.

Rip Mix Burn? The issue here isn't the usual, "Did they sell out?" It's more a case of, Is this stellar groups saying Napster is OK (in a roundabout way), or did they just need the cash?

Disney's Michael Eisner on what to do about all those kids who use Napster: Arrest and prosecute the little SOBs. I know I'd sleep better at night knowing that those devious conspiratorial 11-year-olds were behind bars. [second item]

Napster takes first steps in trying to appease the RIAA, and specifically BMG. To me this approach is the stupidest thing Napster could have done. Who would want to pay a membership fee to use Napster if one can't even burn the files onto a cd?

The ninth circuit court will be releasing their verdict on the linked page by 10am PST (noon CST). Is this the end for poor old Napster, or will other options be made available?

What the Bertelsmann-Napster deal means.
"Hank Barry, chief executive of Napster, has suggested a monthly fee of about $4.95 might be appropriate, but he stressed that fees had not been set." (NYT article; grow up.)

Sopranos to whack Napster. The story behind the cartoons is only mildly interesting, but the Flash animations themselves (courtesy of the "Napster Bad" Metalli-toons guys) are worth checking out (you can also go right to the mirror site here).

Napster and convergence again. I suppose, like Lance, I can't get tired of this conversation much, either. I mean, my head might explode as I try to run down all the ramifications and possibilities, but I doubt I'd get tired of trying to work it out.
Although, it would probably be better to stop just talking about it and jump out in front and start doing things with those thoughts.
But, this isn't a 'damn Napster' point. It's a convergence thought. Will people buy a server and storage medium when they hbuy a house, lke we buy a new fridge today so they can network their lives? What's going to be the new compensation plan for content? How can infomration be guarranteed?

Mister Lance adds a bunch more words into the Napster debate. "Napster bad," he says, for the most part. But the opinions are thought-out and justified.

I've been converted - Earlier today, I was arguing with some coworkers to the effect that napster was protected and should be free and clear. Between the document at the above link and the information in the RIAA injunction brief, it looks like I might have been wrong.
Why can't these guys use more discretion in their e-mails? They might have been OK if they'd kept their mouths shut.

Imminent Death of Internet Predicted! Napster killed the Internet star, says record exec Edgar Bronfman Jr. "Let me tell you what else is in trouble here: the Internet. In the end, the Internet itself will not be able to survive if it becomes a haven for illegal activity. Copyrights must be protected online."

No one seems to have pointed out the Napster press release. It lists the points made in their legal brief, and, by cracky, they're all damned good ones. Their lead lawyer is the guy who just split Microsoft up; I think he might be able to win it; what do you think?

Motley disses Metallica Mister Sixx and pals give their response to Lars' crew, on the whole mp3/napster issue. Sounds like 2 groups of people are benefitting from all these lawsuits, lawyers and flash-cartoonists...

Look! I got banned. And all for spite. I thought it'd be nice and irritating to download his stuff after he started a dispute. I did the same with Metallica. After hearing their music, I'm surprised they have the balls to defend such crap. It's like kicking a garbage can full of screaming monkeys down the stairs.

Trey Anastasio (Phish) on Napster. I know we're all kind of sick of this now. The interesting thing is that I got an MP3 of "Heavy Things" (which is on their new album) this morning from Napster, listened 3 times and then called my local HMV to see if they had the album in yet. They did, and I'm off to buy it. (Feeling legit? You can get Liquid Audio versions of two cuts from the new album, including the one mentioned.)

WTF!?! Everyone's favorite band (back in high school) Metallica is suing Napster and a handful of universities for unlawful trading of their music. This is ridiculous, and I hope it doesn't set a precedence. If anyone would just slap a revenue model on napster so artists could get paid for their work, none of this piracy crap would happen. And Metallica, what about the other apps that do the same thing, are you going to sue them too? And what about every other band on earth? What do you expect to get out of universities, tighter controls over bandwidth, or student monitoring of internet usage? What about every cable modem and DSL provider that lets people use Napster, are you going after them too? Why don't you sue everyone on earth that's heard your songs but didn't pay for them? Side question: Is it better to burn out or fade away?

Rex Reed will probably be getting some bad reviews in the future, thanks to today's arrest for shoplifting CDs from a New York music store. Too bad he never got into Napster and mp3s, maybe this would have never happened. I think I own all three of those CDs, actually. Rex, I would have let you download them!

Contrary to what the record industry thinks, mp3s sell CDs. Today I bought "Irish Drinking Songs" after hearing "Water is Alright in Tay" and "Beer, Beer, Beer" mp3s I downloaded from Napster. Hearing the beer song brought back a distinct memory. I recall hearing it blaring from a jukebox and singing along with 50 strangers at an Irish pub in San Francisco on New Year's Eve, 1998.
