Waukeshocker! After Tuesday's painfully close, still undecided Supreme Court race between JoAnne Kloppenburg and David Prosser, Republicans warned that partisan election officials in certain municipalities might conveniently find bushels of extra uncounted votes after the fact. It has come to pass -- but the extra votes were found in deep-red Waukesha County, represnting the entire city of Brookfield, and give GOP favorite David Prosser a probably insurmountable 50.2%/48.8% lead. Waukesha County Clerk Kathy Nickolaus's policy of storing election returns on a personal computer in her office with no backup was criticized last August. Nate Silver says the new numbers look reasonable.

Many people are up in arms (heh) over the Supreme Court's decision regarding gun control, but rather less press is being given to another opinion handed down today: Davis v. FEC. The issue was the constitutionality of the "Millionaire's Amendment", which allowed for political candidates facing self-funding challengers who intended to spend more than $350,000 to raise more money from individual donors than they would otherwise be allowed to do. In a 5-4 decision, the court found the law unconstitutional. [more inside]

"For those who are feeling this election doesn't much matter, who think it's a choice between Tweedledum and Tweedledee, the court is the reason to care," said Lois Williams, senior counsel for litigation at the Washington Lawyers Committee for Civil Rights, a liberal advocacy group.

"If we get another Scalia or Thomas, we are courting disaster," said Ralph Neas, president of People for the American Way. "We are just one election away, and one or two new justices away, from the civil and constitutional rights we take for granted being eroded or eliminated overnight."
