Kudzu and the California Marriage Amendment Proposition 8 Eliminates Right of Same-Sex Couples to Marry: Initiative Constitutional Amendment SECTION I. Title This measure shall be known and may be cited as the "California Marriage Protection Act." SECTION 2. Article I. Section 7.5 is added to the California Constitution, to read: Sec. 7.5. Only marriage between a man and a woman is valid or recognized in California. The biggest problem is that laws like the California initiative will make the courts decide who is male and who is female — and all available decision criteria create unavoidable miscarriages of justice that will, or should, dismay initiative proponents. You're probably thinking, about now, that I'm going to exaggerate the sex-definitional 1 problem: Probably, you and everyone you know is unambiguously male or female — or at least has always believed himself or herself to be so, and nobody's challenged that, and nobody's likely to. That's true, absolutely: Only maybe one live birth in 100 has some non-standard sex anatomy, and genetic anomalies are slightly rarer than that. However, let's talk about those 1-in-100 or 1-in-1000 cases — because those could be you, or your aunt, or your best friend — and because our system of law has to deal with 1-in-1000 situations, too.

With a ruling scheduled today on Prop 8 — the California ballot measure that took away the right to marry from same-sex couples — Dave Fleischer has an in-depth analysis of all of the polling data on Prop 8, and his findings include some counter-intuitive numbers, like that the confusing wording actually ended up helping the No vote more than the Yes.

Conservative Republican California State Assemblyman Michael Duvall (Orange County) didn't realize his mic was live, moments before the start of a legislative hearing this past July. So when the 54-year-old married father of two began describing his ongoing affairs with two different women in very graphic detail for the benefit of a colleague seated next to him, he had no idea that he was being recorded. A new California proposition attempts to neutralize Prop 8 by substituting "domestic partnership" for "marriage" in state laws, thus leaving marriage to the Mormons and other interested parties. It's morning in America again -- but for the thousands of committed gay couples who got married in California [warning: Dan Fogelberg music, sweet visuals], the long nightmare of intolerance and hate is not yet over with the probable victory of Proposition 8. Supported by the anti-equality stances of Sarah Palin and "divinely" inspired others, and paid for by members of the Mormon Church and the mother of Erik Prince, founder of Blackwater, many of the ads for Prop. 8 featured the faces of Obama and Joe Biden, who declared their opposition to the initiative but refused to support equal marriage rights for all, preferring to talk about "civil unions." Even excellent Democratic-leaning politics sites like Talking Points Memo were saturated with the deceptive ads, which overwhelmed those comparing the proposition to other forms of discrimination in California's history.

As the gay marriage fight unfolds in California, some gays (and others) are fighting back: one gourp is boycotting a rich hotel owner, others are standing apart and one is suing the Bible (who gets subpoenaed for that one?). Meanwhile, a key opponent to gay marriage keeps its doors open (and its ballot committee going) despite being suspended. They say they're working on it, but no changes yet.

New Hampshire approves same-sex unions with bipartisan, if contentious support, recognizing both in- and out-of-state unions and marriages. While New York's Eliot Spitzer follows up on a campaign promise, higher courts in California and Connecticut may make decisions on the constitutionality of same-sex marriage later this year, deciding if a civil union is an adequate legal substitution for marriage.
