"Liberal Hawk" Peter Galbraith played a major role in justifying the American invasion of Iraq. Later he helped write the new Iraqi constitution. Turns out he failed to disclose the hundreds of millions he stands to make on Kurdish oil fields, in part because of his engineering of the same constitution to put him in a favorable business position. Another blogger remembers the good ol' days of 2003 when the media and politicians were shocked --shocked! -- that anyone would dare suggest that the invasion and occupation of Iraq was "all about oil."

A Russian policeman speaks out

During the last week, a senior detective in Novorossiysk, Russia named Alexei Dymovsky had a viral hit on YouTube with a series of videos (in Russian: 1, 2. With English subtitles: 1) complaining about working conditions, accusing officers of corruption, and claiming that he and other police were ordered to stage crimes in order to put innocent people in jail. Dymovsky was promptly fired, but the Russian government has since admitted that parts of the police have been turned into criminal businesses. More here and here.

Charles Hood, sentenced to death for a double murder committed in 1989, is currently fighting for his conviction to be overturned and subsequent death sentenced to be stayed. Why? Because the lead prosecutor and judge were having an alleged affair at the time of the trial. The Texas Court of Criminal Appeals, no strangers to controversy regarding the possible misuse of the death penalty, declined to hear the petition lodged by Hood's lawyers regarding the fairness of the trial saying the defense should have brought the issue up at trial despite the lack of evidence towards the allegations until recently. Imagine you're living in China, trying to work your way out of the family date farming business (which garners approximately $450 annually). You do all the right things. You apply for (and receive) Communist Party membership. You study literally to the point of collapse, and despite coming from coal-town origins, you score high on your gao kao ("high test," more-or-less the only thing that matters in getting into a Chinese university). Your already-poor family goes deep into debt to send you to college, and you even manage to come out with a degree. Classic rise-up-by-your-own-bootstraps tale, right? However, finally, when you go to apply for a job—your state-sanctioned educational, occupational, and political records are inexplicably, awfully gone. What has happened to that plain manila folder (!) that serves as your only legitimate, official history in Chinese society? Probably stolen and sold so a party official's child can get everything you worked so hard for. And then, of course, your family is detained by party officials when your parents demand to know where the hell your life went. Of course. Then again, local corruption by local officials in China isn't terribly surprising. It's had some time to evolve. This just isn't what you normally think about when you think "government corruption."

University of Iowa Creative Writing professor Robin Hemley on Guggenheim Fellowship in the Philippines first broke the news through a McSweeney's dispatch that the Bureau of Customs in the Philippines has begun to tax imported books, in direct violation of the Florence agreement. Concerned netizens rally against the government by spreading the news, causing #bookblockade to get trended on twitter. Neil Gaiman's tweet. More and more updates. An update from Robin Hemley. An excerpt: Customs Undersecretary Espele Sales explained the government's position to a group of frustrated booksellers and importers in an Orwellian PowerPoint presentation, at which she reinterpreted the Florence Agreement as well as Philippine law RA 8047, providing for "the tax and duty-free importation of books or raw materials to be used in book publishing." For lack of a comma after the word "books," the undersecretary argued that only books "used in book publishing" (her underlining) were tax-exempt. "What kind of book is that?" one publisher asked me afterward. "A book used in book publishing." And she laughed ruefully. I thought about it. Maybe I should start writing a few. Harry the Cultural and Educational Potter and His Fondness for Baskerville Type. Likewise, with the Florence Agreement, she argued that only educational books could be considered protected by the U.N. treaty. Customs would henceforth be the arbiter of what was and wasn't educational. "For 50 years, everyone has misinterpreted the treaty and now you alone have interpreted it correctly?" she was asked. Due to “credible death and kidnapping threats”, T-Pain has cancelled a concert in Guyana for Mashramani, the festival that marks the anniversary of Guyana’s independence from Great Britain. Last years, celebration was soured by a killing spree perpetrated by a heavily armed gang led by man known as “Fine Man”. Because the 23 victims were mainly of East Indian descent, the massacre was a powder keg issue for the tiny South American nation. With a population of 44% East Indian and 30% African ancestries, Guyana tends to be socially and politically divided along ethnic identity lines. What initiated the February 2008 rampage was the fact that “Fine Man’s” (Rondell Rawlins) 18 year-old pregnant girlfriend went missing. The gang leader accused the Ethnic East-Indian controlled government of kidnapping her; employing secret, yet sanctioned vigilante squads to do so. Allegedly linked to the then Guyanese Minister of Home Affairs, these ‘Phantom Death Squads’ have been responsible for the murders of suspected criminals and escaped convicts since 2002. Such squads have also been linked to a prominent Guyanese businessman who may have motives of his own when it comes to his involvement with them. “Fine Man” was killed in a police raid last September. His girlfriend has yet to be found.

On January 26^th. two Pennsylvania judges were charged with taking $2.6 million in kickbacks to send teenagers to youth detention centers run by PA Child Care and Western PA Child Care. The judges are scheduled to plead guilty to fraud tomorrow in federal court."Youngsters were brought before judges without a lawyer, given hearings that lasted only a minute or two, and then sent off to juvenile prison for months for minor offenses." The judges are also accussed of helping the two firms "attain nearly $30 million in county contracts." A preliminary audit [PDF] of the companies has also turned up questionable expenses billed to the state. College basketball tickets, fishing trips and a $3,500 suit are among $1.26 million in expenses under scrutiny.

"Among the offenders were teenagers who were locked up for months for stealing loose change from cars, writing a prank note and possessing drug paraphernalia. Many had never been in trouble before. Some were imprisoned even after probation officers recommended against it. Many appeared without lawyers, despite the U.S. Supreme Court’s landmark 1967 ruling [In re Gault, 387 U.S. 1] that children have a constitutional right to counsel."

Oh, and the owner of the detention centers is now claiming he was the victim of an extortion scheme perpetrated by the judges.

Teapot Dome 2008 -- "The report also detailed cozy relationships between energy companies and other officials in the royalty-in-kind program office. Some 19 officials — a third of the staff — took gifts from oil and gas executives, some with “prodigious frequency,” it said."

On one occasion in 2002, the report said, two of the officials who marketed taxpayers’ oil got so drunk at a daytime golfing event sponsored by Shell that they could not drive to their hotels and were put up in Shell-provided lodging. Two female employees “engaged in brief sexual relationships with industry contacts,” the reports’ cover memo said, adding that “sexual relationships with prohibited sources cannot, by definition, be arms’ length.”

Caught smuggling, tobacco firms pay $1-billion in penalties. Two of Canada's big three tobacco companies will pay more than $1-billion in criminal and civil penalties for orchestrating the wholesale shipment to the United States of cigarettes that were smuggled back into Canada and resold at bargain prices. Tax-free cigarettes poured south (from Canada to the US) by the truckload, most commonly through the porous St. Regis Mohawk Akwesasne reserve, near Cornwall, Ont., which straddles the U.S.-Canadian border. From there they were distributed to smugglers who brought them back to Canada to be resold on the street and in convenience stores (tax free). Anti-smoking groups have mixed feelings about Big Tobacco fines in this instance. "If you or I had any intention of defrauding the government of a couple of million dollars, we'd be thrown in jail," said François Damphousse, the Non-Smokers' Rights Association's Quebec director. "Why aren't the executives facing such charges for having defrauded the government of billions of dollars?" (Key executives who orchestrated the smuggling operation in the early 90s have avoided jail time). But the bigger issue is a massive C$10 billion lawsuit brought by British Columbia against the tobacco industry. The province is suing for state-sponsored health-care costs allegedly racked up because of the effects of tobacco products...the trial is to start in late 2010...(and is seen) as an attempt by politicians to destroy an industry they regard as immoral. [The same two tobacco companies, RJN and Philip Morris, have gotten into trouble in the past for essentially smuggling cigarettes into the EU. The Pentagon's $1 Trillion Problem. Even as the Defense Department prepares to send Congress its $481.4B FY2008 budget request, it also prepares to admit -- for the 18th year in a row -- that its finances are in such poor shape that it is effectively impossible to audit or account for over a trillion dollars in past expenses. "For the first three quarters of 2007, $1.1 trillion in Army accounting entries hadn't been properly reviewed and substantiated, according to the Department of Defense's inspector general. In 2006, $258.2 billion of recorded withdrawals and payments from the Army's main account were unsupported. It's as if the Army had submitted multibillion-dollar expense reports without any receipts." Not that it's a new problem, however: "In 1990, Congress enacted legislation requiring all federal agencies to pass independent audits. Every year, the Defense inspector general dispatched dozens of auditors to the military's financial and accounting centers. Every year, they reported back that the job couldn't be done. Defense Department records were in such disarray and were so lacking in documentation that any attempt would be futile. In 2000, the inspector general told Congress that his auditors stopped counting after finding $2.3 trillion in unsupported entries made to force financial data to agree." Annual audits were suspended indefinitely in 2002. And in an interesting historical note: the 'Mechanization of Contract Administration Services' (MOCAS) system, which "pays invoices and vouchers for hardware supplies and services"*, was originally brought on-line in 1958, making it half a century old this year.

And the wheels start coming off again.

"It's ethnic cleansing happening." Fully ten days after elections that most are speculating were indeed won by the opposition party (Movement for Democratic Change), Robert Mugabe still clings to power in Zimbabwe. The voting results have still not been released, and 5 election officials have been arrested, "accused of tampering with the vote to the detriment of Mugabe's tally." Its been a tense time for Zim, and now the violence and land seizures have started again. This morning it was reported that 60 white farmers have now been driven from their lands by "groups of as many as 200 young men, organized and paid by ZANU-PF and chanting party slogans and shouting anti-white epithets." That's over 10% of the remaining white farmers left in Zimbabwe, after the thousands in the last few years that had their lands seized at Mugabe's behest: "Land must remain in our hands - the land is ours, it must not be allowed to slip back into the hands of whites." South Africa's Thabo Mbeki is expected to meet with the opposition leader. Tutu remains hopeful that Mugabe will step down, but gangs are going after opposition voters.

The Hillsong Church

The Hillsong Church has been a controversial church in Australia for quite some time (13mb mp3 link). From questions over its political influence to claims that they were stacking the votes in Australian Idol to concerns about the way it uses its donations, Hillsong continues to inspire much debate over whether it is a force for good or whether it is corrupt. In the latest controversy to surround the church, they are now claiming that they can cure homosexuality. Hardly a first for a Christian church except that Hillsong, which has a strict doctrine that teaches homosexuality is an affliction that can be cured, is so obsessed with ensuring that there are no homosexuals under their roof that it is running the program for its own disciples... even those who aren't gay. Allegedly, they are going so far as to issue "separation contracts" to young women who simply make friends with each other and which prevents any form of physical contact between residents. Ex-residents claim that to help in Hillsong's endeavour to rid themselves of homosexuals, Hillsong has gone so far as to enlist the services of Sy Rogers, an American 'ex-gay' (now reformed) married Christian who spoke at their MegaChurch last year. Hillsong uses Roger's Youtube show Turnaround, in which he claims "Happily, homosexuality can be turned around. Homosexuality is out of tune with religion; it is not what God planned for human sexuality." Mercy Ministries, who own Hillsong, have denied running such a program and, according to the Brisbane Times article, Hillsong has not answered questions regarding their views on homosexuality. Brian Houston, the senior pastor at the church has been described by some as a great man. Is he? Or is he simply the head of a church with no answers?

Campaign Finance Bites the Hand That Made It

Last year, as McCain's campaign seemed stumbling into the grave, it applied for federal matching funds for the primary season. After Super Tuesday, McCain withdrew from the system. Or did he? If he didn't, he's capped at $54 million to spend till September -- and he's already spent $50 million of it. Former FEC Chairman Brad Smith tells, in bravura detail, the whole whirling story. (via Election Law Blog) McCain attempted to withdraw not having received any matching funds. Receiving any funds would have locked him into the system. He did, however, obtain a loan in December 2007 which pledged as collateral -- not the federal matching funds he had already qualified for, as that would legally lock him into the system -- federal matching funds which he would receive as a result of pledging, in the loan documents, to reenter the matching funds system if he dropped out of it in December and subsequently did poorly in New Hampshire! Now there's a question of whether he can actually withdraw or not. Meanwhile, the FEC lacks a quorum to make a ruling, and Obama put a hold on nominees who might have given it a quorum. And there are other complications, like how entering the matching system might have put McCain on the Ohio ballot at minimal expense. Brad Smith's conclusion: the law is way too complicated.

In trademark style, Lawrence Lessig today announced the creation of a congressional exploratory committee. If in the next few days he decides to officially enter the race, he'll be running in the special election on April 8th to fill the CA-12 seat recently vacated by the death of Tom Lantos. A run by Lessig would likely be seen as a new front the the technocratic, post-partisan movement Barack Obama is attempting to catalyze; Lessig was a colleague of Obama at the University of Chicago law school, helped to draft Obama's technology plan, and is describing his potential run (his first attempt at public office), and the larger Change Congress project he also announced today, as an attempt to save Congress as an institution from the corrupting influence of money. Lessig would be an untraditional democratic candidate; he began his law career clerking for Justice Scalia, and gained celebrity fighting against Hollywood and the RIAA for shorter copyright terms and expanded fair use. This move comes only months after Lessig moved on from that work to focus on political corruption, saying at the time

I have come to believe that until a more fundamental problem is fixed, [the free culture movement] can't succeed either. Compare: Imagine someone devoted to free culture coming to believe that until free software supports free culture, free culture can't succeed. So he devotes himself to building software. I am someone who believes that a free society -- free of the "corruption" that defines our current society -- is necessary for free culture, and much more. For that reason, I turn my energy elsewhere for now.

This announcement comes after a week of efforts to draft Lessig into the race on Facebook, MySpace and elsewhere.
