On the same day that a Colorado judge struck down that state's ban on same-sex marriage (pdf), the Utah Attorney General’s Office announced it will take the issue of same-sex couples’ marriage rights back to the Supreme Court, bypassing a 10th Circuit en banc review. All of this news comes just one day after several prominent LGBT groups announced they will no longer support the Employment Non-Discrimination Act, as written, due to the religious exemptions therein. President Obama is facing pressure from religious groups to write a religious exemption into his promised executive order to protect LGBT federal contractors and workers from discrimination.
By a vote of 64-32. the United States Senate has passed the Employment Non-Discrimination Act. Full passage of ENDA would make it illegal to discriminate against someone on the basis of sexual orientation or gender identity. It is already illegal to discriminate on the basis of race, color, sex, nationality, religion, age or disability. [more inside]
"[T]he Commission hereby clarifies that claims of discrimination based on transgender status, also referred to as claims of discrimination based on gender identity, are cognizable under Title VII's sex discrimination prohibition"On April 20, the US Equal Employment Opportunity Commission (EEOC) issued a unanimous ruling for the plaintiffs in a lawsuit brought up by the Transgender Law Center on behalf of Mia Macy, who claimed she was denied a job as at the Bureau of Alcohol, Tobacco, Firearms and Explosives after she announced she was transitioning from male to female. The decision allows for people who have been fired or prohibited from applying for a job based on their gender identity to bring federal lawsuits against their employers under Title VII of the Civil Rights Act of 1964. ENDA House hearings start tomorrow --a record 94% of Fortune 500 companies now provide Sexual Orientation Discrimination Protection, and 89% of Americans polled believe Homosexuals should have equal rights in terms of job opportunities. Repeatedly introduced and then killed since 1994, the 2007 version--H.R. 2015--Employment Non-Discrimination Act (text of bill)--includes transgender protection for the very first time. The TVC is just one of many organizations fighting it. (there is a religious exemption, but groups like the TVC would be covered by it)
