The War on Whistleblowers

The year 2009 began a disturbing new trend: the criminalization of whistleblowing. The Obama administration has pursued a quiet but relentless campaign against the news media and their sources. This Article focuses on the sources who, more often than not, are whistleblowers. A spate of “leak” prosecutions brought under the Espionage Act has shaken the world of whistleblower attorneys, goodgovernment groups, transparency organizations, and civil liberties advocates. The Obama administration has prosecuted five criminal cases under the Espionage Act, which is more than all other presidential administrations combined. [more inside]

What if justice finally comes creeping around?

Eric Holder has announced a full criminal investigation into the deaths of two detainees in CIA custody. The breaking story is also being reported by Talking Points Memo. This latest development comes as a result of a preliminary DOJ investigation into possible criminal acts stemming from the Bush torture policies that President Obama requested in August 2009, which was broadly criticized at the outset as not going far enough.

Obamaryjane

MEMORANDUM FOR SELECTED UNITED STATES ATTORNEYS: As a general matter, pursuit of these priorities should not focus federal resources in your States on individuals whose actions are in clear and unambiguous compliance with existing state laws providing for the medical use of marijuana. For example, prosecution of individuals with cancer or other serious illnesses who use marijuana as part of a recommended treatment regimen consistent with applicable state law, or those caregivers in clear and unambiguous compliance with existing state law who provide such individuals with marijuana, is unlikely to be an efficient use of limited federal resources. Keep It Like a Secret

Eric Holder releases newly revamped state secrets policy. In the face of a storm of recent criticisms from political commentators that President Obama's policies on state secrets privileges represent a continuation of the Bush administration's policies, the Obama administration has maintained all along that these policies were undergoing comprehensive Justice Department review, with the intent of releasing a new set of comprehensive rules governing the invocation and abuse of state secrets. Today, the Obama administration spelled out its new state secrets policy. [more inside]

Green Grow the Rushes Go

U.S. Attorney General Eric Holder is signalling that marijuana policy will now be considered a matter of state jurisdiction. For obvious reasons, medical marijuana champions are celebrating the administration's committment to depart from the Bush and Clinton eras' previous policies of conducting frequent DEA Raids on medical marijuana dispensaries in California. But with recent signs of a U.S. economy in even more rapid decline than anyone anticipated, and with California being particularly hard hit, some California politicians are suggesting the time has finally arrived to end the prohibition and put full legalization of marijuana on the table, pointing to potential windfalls in the range of a billion dollars in new tax revenue annually.
