eToys is back online. Wall Street Journal: "Before it shut down, eToys lost hundreds of millions of dollars. But much of that cash had been spent to build a brand that made eToys one of the best-known names in online retailing. KB Toys recognized the value of the brand, and this summer acquired the defunct company's assets for $14 million," and has since relaunched the site as a skin for their own store, but with the look and feel of the original etoys.com.

eBay takes a leaf out of eToys' book. Everybody's favourite auction site is threatening legal action against EBay Pty Limited, an Australian company that’s been around for twenty years but only got online recently. eBay has the ebay.com.au domain name, so EBay bought ebayaust.com in late 1999 for their small business selling self-published books.

Now eBay wants EBay to stop using the name both online and offline, the latter of which seems highly dubious given the relative ages of the companies.

In what is becoming an increasingly global marketplace, where do we draw the line between disparate companies with similar names?

Schadenfreude update: eToys has officially announced it will file Chapter 7 and liquidate in 5-10 days. And, as expected, Disney started Round 2 of layoffs from its cash-hemmoraghing operation, this time gutting ABCNEWS.com and ABC.com.
Etoys to lay off 70% of its workforce in their never ending quest for profitability. Does it really take 1,000 employees to run an e-commerce site? I hope not, since there will only be 300 left after today. I imagine most of those employees were in the fulfillment end of the business.

Now this could possibly be Schadenfreude at it's best!! "eToys Expects Lower Than Estimated Fiscal Third Quarter Operating Results" Net sales are expected to be between $120 million and $130 million, rather than the $210 million to $240 million previously estimated. How could they be off their estimate by HALF? Oh yeah, maybe if they hadn't spent so much time (and money) pursuing ETOY?
Finally! eToys.com drops the suit against ETOY.com and agrees to pay up to $40,000 of their legal fees. Finally! Now, I wonder what the group of people I built etoys-sucks.com with are going to do with the domain?

Well, the eToys/ETOY fiasco may be over. Although, I don't like it when their lawyers say they're not pushing the case any longer, and specifically saying they're not dropping the case. As if the threat will always be there or something.

Network Solutions has pulled etoy.com's domain record and email sent to any etoy.com address is bouncing. Since when did a judge in Southern California and a domain registrar in Virginia ever get the idea that they control the internet and can make these decisions that affect the world? In response to this, one of the protestors bought fuck-you.com, which is currently pointing at etoys.com.

A group of folks from the evolt.org mailing list decided to do something to protest etoys's recent actions. One person purchased a domain, another setup web space, a couple people wrote some articles and I designed the site. Keep that boycott going.
