In September of 2004, a Superior Court in Washington state ruled the state's 1998 "Defense of Marriage" act unconstitutional, a ruling which would have allowed the state to issue marriage licenses to same-sex couples. In 2006, the state Supreme Court issued in an opinion in Andersen v. King County overturning the lower court's ruling, noting "that our decision [pdf] is not based on an independent determination of what we believe the law should be." The legislature, in response, created the state-registered domestic partnership in 2007, expanding many (but not all) marriage-related rights to same-sex couples. Last month, a new law expanded the partnership to cover the remaining rights, creating an "all-but-marriage" partnership.

This year, the Washington Values Alliance has filed Referendum 71, which would put this expansion to a ballot vote. The referendum will need 120,000 signatures to make it to the ballot. WhoSigned.org intends to make these signatures searchable. Predictably, this is creating some controversy. [more inside]

Maine House votes in favor of marriage equality, 89-57. In the process, Rep. Sheryl Briggs reveals that she cannot vote for the bill, despite the fact that her daughter is a lesbian. No word yet as to whether Governor John Baldacci will sign the legislation, but a campaign for a People's Veto is already underway.

Today, the Vermont Legislature voted to override Gov. Jim Douglas' veto of a bill allowing same sex marriage, making Vermont the 4th state in the nation (and the second state this week) to legalize same sex marriage. Vermont is the first state to do it legislatively; it happened in the other three states via court ruling.

It's morning in America again -- but for the thousands of committed gay couples who got married in California [warning: Dan Fogelberg music, sweet visuals], the long nightmare of intolerance and hate is not yet over with the probable victory of Proposition 8. Supported by the anti-equality stances of Sarah Palin and "divinely" inspired others, and paid for by members of the Mormon Church and the mother of Erik Prince, founder of Blackwater, many of the ads for Prop. 8 featured the faces of Obama and Joe Biden, who declared their opposition to the initiative but refused to support equal marriage rights for all, preferring to talk about "civil unions." Even excellent Democratic-leaning politics sites like Talking Points Memo were saturated with the deceptive ads, which overwhelmed those comparing the proposition to other forms of discrimination in California's history.

As the gay marriage fight unfolds in California, some gays (and others) are fighting back: one gourp is boycotting a rich hotel owner, others are standing apart and one is suing the Bible (who gets subpoenaed for that one?). Meanwhile, a key opponent to gay marriage keeps its doors open (and its ballot committee going) despite being suspended. They say they're working on it, but no changes yet.

Massachusetts will retain gay marriage. For now. The initiative petition which sought to amend the Massachusetts constitution to ban gay marriage (thereby revoking the decision of the Supreme Judicial Court in Goodridge v. Dept. of Public Health) will not appear on the ballot. The petition needed the votes of fifty legislators in two consecutive constitutional conventions to proceed; my representative was one of the nine house members who changed their votes from the last time. Washington Initiative Requires Proof of Procreation From Married Couples -- in response to a ruling made by the Washington Supreme Court last year stating gay and lesbian couples could be prevented from marrying by the state because Washington has a legitimate interest in preserving marriage for couples who can procreate. It's been accepted by their Secy of State, and only needs signatures now to get on the ballot. Press release here, which adds: The time has come for these conservatives to be dosed with their own medicine. If same-sex couples should be barred from marriage because they can not have children together, it follows that all couples who can not or will not have children together should equally be barred from marriage.

Israel has partialy recognized same sex civil unions since 1994.^wp The Netherlands, Belgium, Spain, Canada, and South Africa are the only other nations to legalize same sex marriage; however, most European nations recognize some form of civil union.^wp

Gay Palestinians often seek refuge in Israel since they may be tortured or killed by the Palestinian Authority; this continues dispite the fact that Jordanian law, as would be applied in the west bank, does not criminalize homosexuality. Israel sadly does not often grant gay Palestinians refugee status, forcing them to remain hidden within Israel.

The GOP-dominated Senate Judiciary Committee backs the Constitutional amendment to prohibit states from recognizing same-sex marriages. In a fractious hearing, Republican chairman Arlen Specter shouted "Good riddance!" when Senator Russ Feingold (D-Wisconsin) walked out. Laura Bush recently advised her party's candidates not to campaign on this issue and to handle it with "great sensitivity." Maybe next time.

Are Texans Poised to Ban All Marriage Altogether? A group opposed to the Texas anti-gay-marriage ballot initiative is pointing out that the language in Proposition 2 (one of nine proposed amendments to the Texas Constitution up for a vote November 8) might actually ban all marriages: gay, straight, whatever. The group -- Save Texas Marriage -- is organizing phone banks, offering signs and fliers, and pointing to language in the measure that would ban "any legal status identical or similar to marriage" without specifying that the ban would apply to gay persons. Prop 2 supporters, of course, are crying foul.

Switzerland Votes for Closer EU Integration What with all the play that the narrow French rejection of the proposed EU Constitution enjoyed, I doubt that Switzerland's successful referendum accepting endorsement of closer EU integration (specifically, enacting the Dublin Convention on shared security and policing) and gay marriage recognition will get much coverage. It just doesn't easily fit into the narrative of an unravelling Europe, one which Swiss voters seem to have rejected despite strong internal debate.

The Wedding of Roy Cohn's spiritual heir (or one of them anyway) was celebrated in Massachusetts in December, and revealed yesterday. The groom, an influential political consultant who has made a practice of defeating Democrats by trying to demonize them as liberal did not invite any of the people he helped bring to power, often on an anti-gay platform. In fact, he didn't even tell any of them (the list includes Jesse Helms and many many more). The happy couple, together for 40 years (since the groom was 19), live in Ipswich, MA with their 2 children. No information on the other groom was provided, nor on honeymoon arrangements.

California joins New York in a lower-court decision for marriage equality, with the judge stating, "The idea that marriage-like rights without marriage is adequate smacks of a concept long rejected by the courts — separate but equal," ... And in DC, Ken Mehlman, (closeted) head of the RNC, in an interview with the AP, backslides on his party's trumpeting of anti-gay sentiment: - It's not his job as head of the party to tell states whether they should allow same-sex couples to wed or form civil unions. "Certainly our platform states that the party is committed to ensuring that there is traditional marriage," he said, but he didn't think the party should take a position on state initiatives. Wedding Bells in NYC?? -- with a beautifully-written ruling, NY Supreme Ct. Justice Doris Ling-Cohan states that denying marriage to gay and lesbian New Yorkers is unconstitutional: ... There has been a steady evolution of the institution of marriage throughout history which belies the concept of a static traditional definition. Marriage, as it is understood today, is both a partnership of two loving equals who choose to commit themselves to each other and a State institution designed to promote stability for the couple and their children. The relationships of plaintiffs fit within this definition of marriage. Similar to opposite-sex couples, same-sex couples are entitled to the same fundamental right to follow their hearts and publicly commit to a lifetime partnership with the person of their choosing. The recognition that this fundamental right applies equally to same-sex couples cannot legitimately be said to harm anyone. ...

Same-sex marriages in Canada may be coming soon, but that's nothing. The Supreme Court of Canada has ruled that it's OK to masturbate in front of your windows! (Full ruling here, previous mefi discussion here.) The Conservatives in Canada worry that all this moral decadence may lead to polygamy, but Canada's had a polygamist community for some time now. Still, the government does seem to be examining the issue. Meanwhile, parents in Atlantic Canada are outraged their children are learning about mutual masturbation and oral sex. Portland joins other cities in offering gay marriages. Multnomah County didn't consult the state Attorney General before they started issuing licenses, though, which is a bit unusual. Forgiveness easier than permission? There's also a Unitarian Church in downtown Portland that is performing same-sex marriage ceremonies, if you're interested in a church wedding.

Flowers for all!!! "Today a coworker of mine had a thought to send flowers to a random couple waiting in line at SF city hall. He called a florist and they agreed to do it. He told them to deliver to any couple -- it didn't matter who -- standing in line to get married, with his blessing. The card will read simply "With love, from Minneapolis, Minnesota." Once they understood, they were very touched and thought it was a great idea. He told another co-worker who did the same thing. And now we want to start a movement. Wouldn't that be cool if people from all over the country, gay, straight and otherwise, started sending flowers to the people waiting in line to get married. Call it The Big Gay Bouquet call it Flowers from the Heartland. Call it whatever you want, but help us get this off the ground.
