In September of 2004, a Superior Court in Washington state ruled the state's 1998 "Defense of Marriage" act unconstitutional, a ruling which would have allowed the state to issue marriage licenses to same-sex couples. In 2006, the state Supreme Court issued in an opinion in Andersen v. King County overturning the lower court's ruling, noting "that our decision [pdf] is not based on an independent determination of what we believe the law should be." The legislature, in response, created the state-registered domestic partnership in 2007, expanding many (but not all) marriage-related rights to same-sex couples. Last month, a new law expanded the partnership to cover the remaining rights, creating an "all-but-marriage" partnership.

This year, the Washington Values Alliance has filed Referendum 71, which would put this expansion to a ballot vote. The referendum will need 120,000 signatures to make it to the ballot. WhoSigned.org intends to make these signatures searchable. Predictably, this is creating some controversy. [more inside]

An ominous new TV ad by the National Organization for Marriage -- who helped pass Prop. 8 in California -- features a "rainbow coalition" of folks to warn America that marriage equality advocates want to "take away" your "freedom" by pushing the issue "far beyond same-sex couples." Unfortunately for NOM, the profound seriousness of this threat has been undermined by a leak of audition reels for the ad.

In 1968, Mattachine Society of Washington co-founder Frank Kameny declared "Gay is Good"; in 1971 he became the first openly gay candidate for the US Congress. But if you're running for president today, while you know gays contribute money and definitely vote, Kameny's or any "gay support could cost candidates":

Quinnipiac University polls of voters in Florida, Ohio and Pennsylvania -- the big three Electoral College swing states -- found voters by large margins more likely to see the endorsement of a gay rights group as a reason to vote against, rather than for, a candidate.

So is the Democratic Party's apparent embrace of gays, as evidenced by tonight's "gay debate," a good idea? Or would greater distance between gays and the Democratic Party help both groups achieve their goals?

Washington Initiative Requires Proof of Procreation From Married Couples -- in response to a ruling made by the Washington Supreme Court last year stating gay and lesbian couples could be prevented from marrying by the state because Washington has a legitimate interest in preserving marriage for couples who can procreate. It's been accepted by their Secy of State, and only needs signatures now to get on the ballot. Press release here, which adds: The time has come for these conservatives to be dosed with their own medicine. If same-sex couples should be barred from marriage because they can not have children together, it follows that all couples who can not or will not have children together should equally be barred from marriage.

Cure for teh gay? I was relaxing in front of X-Men 3 when a friend mentioned that the United States "gay sheep" experiments were wrapping up (though not uneventfully), with considerable successes. Lesbian tennis champ Martina Navaratilova has been fighting to end the tests for some time, but it appears a "gay vaccine" for pregnant mothers may be inevitable. Meanwhile, the GOP's only gay congressman retires.

Patricia Todd won a tight Democratic party runoff in District 54 in Alabama. Patricia Todd is also gay and would be the first gay representative in Alabama's history. Gaynell Hendricks doesn't understand why she lost, but maybe it has to do with the race baiting . Hendricks' mother-in-law contests the election for numerous reasons including "illegal votes were given to Todd" and said that "I want this controversy settled.This is happening like when Bush and Gore were running for president. I don't like it." Unsurprisingly, "Hendricks said she is pleased that someone challenged the results. " Weeks go by and the results don't get certified. A five member committee is appointed and bickers. Eventually the committee refrerences an old by law that has apparently not been enforced since 1988 to disqualify Todd. Although it does not seem quite over, it should be by tommorrow. Interestingly enough, Todd said she believes the challenge has nothing to do with the fact she is gay, but is about the fact that she is white and won in a majority black district.

Are Texans Poised to Ban All Marriage Altogether? A group opposed to the Texas anti-gay-marriage ballot initiative is pointing out that the language in Proposition 2 (one of nine proposed amendments to the Texas Constitution up for a vote November 8) might actually ban all marriages: gay, straight, whatever. The group -- Save Texas Marriage -- is organizing phone banks, offering signs and fliers, and pointing to language in the measure that would ban "any legal status identical or similar to marriage" without specifying that the ban would apply to gay persons. Prop 2 supporters, of course, are crying foul.

Want to see the results of all the hateful anti-gay rhetoric? While other forms of crime continued to fall, the National Coalition of Anti-Violence Programs has documented a 4% increase in anti-LGBT crime in 2004, coming on the heels of a 26% increase in the last half of 2003. This spike in violence parallels the exact same period since the Right went into demonic, anti-gay hyperdrive following the Supreme Court's Lawrence v. Texas decision in July of 2003. Since then, church pews and the public airwaves have been awash in ugly, anti-gay rhetoric and fear-mongering. And in DC, Ken Mehlman, (closeted) head of the RNC, in an interview with the AP, backslides on his party's trumpeting of anti-gay sentiment: - It's not his job as head of the party to tell states whether they should allow same-sex couples to wed or form civil unions. Same-sex marriages in Canada may be coming soon, but that's nothing. The Supreme Court of Canada has ruled that it's OK to masturbate in front of your windows! (Full ruling here, previous mefi discussion here.) The Conservatives in Canada worry that all this moral decadence may lead to polygamy, but Canada's had a polygamist community for some time now. Still, the government does seem to be examining the issue. Meanwhile, parents in Atlantic Canada are outraged their children are learning about mutual masturbation and oral sex. What's next -- adults-only barbershops? Oh, wait....

I'll take Closeted Republican Congressmen for 800, Alex. Wonder why you haven't seen GOP Rep. David Dreier of California on tv lately? One of the most visible public faces of the GOP is outed, thanks to Blogactive, who gives him a Roy Cohn Award for 24 years of working against gay and lesbian rights while living as a gay man yourself. "They have no business debating the efficacy of gay marriages, any more than they should be debating the pullout of troops from South Korea" North of Detroit, a county commissioner and avowed Christian Conservative pushed a resolution supporting an amendment to the Michigan state constitution, declaring marriage to be a strictly man-and-woman affair. It passed in Oakland County's Board by a narrow margin. But the county executive, a longtime prominent conservative, won't let it go without a fight, and says that with an urban county seat, Pontiac, they should have better things to do-- like their jobs. Is a county board seat an appropriate forum to push another agenda, or should they be more concerned with fixing roads and economy? Does such a resolution at such a low level of goverment even mean anything? Meanwhile, some couples are saying heck-with-it and making that trip 'cross the Ambassador Bridge.

Anti-immigration candidate Pim Fortuyn forges ahead in the Netherlands This guy is interesting - he's openly gay yet is the figurehead of the new right in the Netherlands. His party came out of nowhere in Rotterdam to take 17 seats and he has ambitions to be Prime Minister. His policy is to halt immigration into the most densely packed country in Europe, while retaining the nation's permissive and multicultural character. Could this be the model for future right-wing parties in Europe? Or is this just media-friendly fascism with a friendly face and a well-cut suit?

Norway Briefly Lead By Gay Prime Minister whilst Egyptian Human Rights Groups Cannot Defend Gays Compare and contrast: this cannot be seen simply as another East/West culture clash, when we know that there are a variety of views in the 'West' about gay 'rights', and indeed within Egypt itself. However, once achieved for homosexuals in western Europe (note the support of the French President), is the march to progressive equal rights going to have any effect on friendly countries elsewhere in the world?
