[TotalitarianismFilter] Don't be asking your college librarian for a copy of that Little Red Book to do a class assignment, or your parents might get a visit from the good folks at the Department of Homeland Security. More evidence that the Bush administration cannot restrain itself when granted enhanced surveillance powers.

First Patriot Act Library Records Enforcement

The FBI has issued the first demand for library records under the Patriot Act. The library in question is somewhere in Bridgeport, CT. The ACLU is seeking an emergency court order to lift the FBI gag order, but they've been instructed by the gag to keep the person whose library records being sought (i.e., their client) a secret. What the ACLU has revealed is that the client is a member of the American Library Association (clearly, a front for terrorism). If any MeFites are interested in digging up additional details on this and start making calls, here's a good place to start. What indeed would the FBI consider so threatening?

Brilliant

Book-readin' bad guys This makes me safer already, knowing the feds are spending their time checking on who's reading about Osama bin Laden. Just &*##$@! brilliant work.

Law enforcement officials have made at least 200 formal and informal inquiries to libraries for information on reading material and other internal matters since October 2001, according to a new study that adds grist to the growing debate in Congress over the government's counterterrorism powers.

In some cases, agents used subpoenas or other formal demands to obtain information like lists of users checking out a book on Osama bin Laden.

Ashcroft Vs The Librarians

After calling our concerns Hysteria and saying we've been Duped by those who are ideologically opposed to the Patriot Act, Ashcroft Now Says the FBI has not sought a single record from a library or business under a part of the Patriot Act widely criticized as opening Americans' reading habits or personal information to undue government scrutiny.
After a Phone Call to the Head of the American Library Assoc, he promised to declassify a report on how often the agency has sought information from public libraries under the USA Patriot Act.
Congressman Bernie Sanders Says who has authored legislation that would amend section 215 of the USA Patriot Act, welcomed reports today that Attorney General Ashcroft, after months of pressure from Congress and national civil liberty and privacy organizations, has agreed to disclose to the public how Section 215 has been used.

FBI in the library

The FBI has not been here. Librarians, who can be required by the FBI to submit library records of private citizens under the PATRIOT Act--and who are prohibited from making these requests public--have invented some clever, legal strategies to fight back.
One hell of an overdue fine

So, we all know the Patriot Act allows for the monitoring of library and computer usage. Big deal, right? I mean how many people can they watch and what are the odds?

Maybe not as good (or bad, depending on your view) as you might think,"A St. John’s College Library visit by a former public defender was abruptly interrupted February 13 when city police officers arrested him about 9 p.m. at the computer terminal he was using, handcuffed him, and brought him to the Santa Fe, New Mexico, police station for questioning by Secret Service agents from Albuquerque."

Welcome to the public library. Please check your rights at the door. The Patriot Act contains provisions that gag librarians when subpoenaed (from a secret court!) for circulation records. Seems like in at least one place, it's already being used. How about your own library?

Is your library unpatriotic? The FBI has now started checking library records. According to the USA Patriot Act, the FBI can research library records, all they have to do is prove a diluted form of probable cause to a secret court. Some librarians say they will resist the attempts by the FBI to view the reading histories of their patrons. If you think your local librarian is being unpatriotic or subversive, please send them hate mail, report them to the FBI.....
