The Day the Music Died The Electronic Frontier Foundation (EFF) [...] has also been warning anyone who would listen that they should not “purchase” encrypted music from these services, since if these services go under then all that “purchased” music will no longer… what’s the word… “play”. But mostly people ignored them (and me), because, you know, Microsoft was at the center of it all, and nobody ever got fired for “buying” from Microsoft.

[Patent Lawsuit Filter] On Wednesday Sun Microsystems announced a counter suit against Network Appliance, wherein they will draw on their "defensive portfolio" which is "one of the largest patent arsenals on the internet". They are going to be requesting a permanent injunction to remove all of NetApp's filer products from the marketplace, and also seeking monetary damages (half of which they've pledged to donate to the Software Freedom Law Center and Peer to Patent Project). Last month, NetApp sued Sun for patent infringements in ZFS. Earlier this month in Texas, the first ever patent infringement lawsuit against Linux distributors was filed.

Microsoft buys stake in Facebook. Microsoft has paid $240m (£117m) for a 1.6% stake in Facebook that values the hugely popular social networking site at $15bn (£7.3bn). Facebook spurned an offer from Microsoft's rival Google, which was also keen to invest the site. Microsoft will also sell internet ads for Facebook outside the United States as part of the deal that took several weeks of negotiating. Mark Zuckerberg started the online social networking site in his Harvard University dorm room less than four years ago.

The Open Content Alliance poses a threat to Google and Microsoft's competing library digitization projects. OCA was founded by the Internet Archive, whose main claim to fame is the Wayback Machine, designed to archive the internet's web history. Space World is a joint project between NASA, Microsoft Live Labs and MSNBC.com. It uses Microsoft Live Labs Photosynth to create 3D tours of the space shuttle Endeavour and NASA's Kennedy Space Center facilities.

In Korea, you use Windows and IE, or you're out of luck. MeFi's own Gen Kanai writes about the Microsoft lock-in in South Korea. It is also a monoculture in other ways, of course, but in a country of 48 million where internet usage has risen from 9 million in 1999 to 35 million today, that leads the world in broadband penetration, some lessons for the rest of the world about the dangers of monopoly might be learned.

Microsoft has been caught paying for Wikipedia edits. But wasn't this inevitable? Now that Wikipedia has become the de facto online reference, wasn't it inevitable that it would attract governments, corporates and other groups to create their own version of events. Is this an inherent and fatal flaw in open source knowledge?

Designing With Microsoft? Evidently this is Microsoft's attempt at competition with 'Macrodobe', the strange, hybrid beast (lumbering?) that is the combined Macromedia/Adobe merger. Microsoft has launched a full suite of products taking aim at Dreamweaver, (is it better?) Illustrator-Photoshop and Flash. For many designers who pretend to be developers (or vica versa) Microsoft's new "Expression" will be 3 or 4 orders of magnitude less relevant than that old Corel Suite. The central issue seems to be one of credibility: Can Microsoft escape the seemingly permanent "FrontPage" stigma, not to mention even more recent design community letdowns?

The LA Times tagged the Gates Foundation today for harmful investment practices. The Gates Foundation generally gets only positive PR for their great work on global health. But today the LA Times presented startling evidence that the foundation's own investments are actually causing much of the harm in the communities where the foundation is working. As the poster child of the free market capitalist system, is it time for Gates to ask whether globalization is a primary cause of the third world poverty his foundation is trying to fix?

people aren't happy about Google canceling it's API and replacing it with an AJAX search widget you're supposed to put on your page (and one that's deliberately obfuscated and difficult to extract data from). Google's obsession with secrecy isn't going unnoticed, and some employees are starting to feel like the magic is gone and they're being treated like children. Today is a big day for Microsoft with the launch of three key products - Windows Vista, Office 2007 and Exchange Server 2007. User groups are already up-and-running. Vista and Office have been available for some time. But maybe this is just clever viral marketing? In spite of lots of new and improved features, Vista has not been well received by reviewers. But this has been true of every Windows version since Windows 95. One thing is certain, these versions will be the last releases that focus on the desktop rather than the Internet.

Ballmer: Linux Users Owe Microsoft. Microsoft CEO Steve Ballmer stated at the Professional Association for SQL Server (PASS) conference in Seattle yesterday, that Linux infringes upon his company's intellectual property. Does this signal preparations for all out war against the open source community? Microsoft's recent acquisition of Novell was seen as an ominous sign. Or perhaps it's a sign that user friendly versions of linux such as Ubuntu threaten sales of Microsoft's problematic new VISTA OS, scheduled for release Nov. 30th for businesses and Jan. 30, 2007 for consumers?

MSNBC soft pedalled the story while others have offered their regurgitated take on the press release. But I can't find anyone asking the tough questions about the new deal between Microsoft and Vivendi/Universal wherein MS will pay Universal a flat price for every Zune player sold.
With big names like David Geffen saying, "Each of these devices is used to store unpaid-for material. This way, on top of the material people do pay for, the record companies are getting paid on the devices storing the copied music." are we really getting to the point where everything we think we know about property and theft is going to be re-defined in terms of someone's perceived loss?

GamerDad, a site which has been around since 2003 (and is a registered trademark), has been a source of amusement and reviews for parents who play games, and parents who want to know what their kids are playing. Microsoft decided that they liked the name so much, they would steal it. But at least they had the courtesy to admit they knew about GamerDad before they stole the name.

It needs an awful lot of RAM, disk space, and VRAM. Yet, with all this power, it suffers from very limited mobility (no, really); it's a big change from previous editions. It might even stop working on you, transforming your powerful workstation into a locked-down web-browsing paperweight (but what about your data?). It might not have the drivers you need to get your equipment working, which will be a problem because it won't load drivers that haven't been "blessed" by its maker. Certainly the technical challenges with Windows Vista are a handful, but what on earth were the Microsoft lawyers thinking when they inserted a clause in its EULA that specifically forbids problem-solving (clause 4)?

To help enforce the genuine advantage, Microsoft will include a "kill switch" in Vista--if it's not validated within a specified time, all of its functions except web browsing are locked down and the machine automatically kicks you out after an hour. Will it mean more Linux users, an excuse to just use Google desktop, or is it just a matter of time until this, too, gets cracked?
