The state of Washington has filed suit against Arlene's Flowers, whose owner, Barronelle Stutzman, refused to provide flowers for the wedding of regular customers Robert Ingersoll and Curt Freed. The case is set to emerge as the first major test of anti-discrimination protections since Washington State voters legalized same-sex marriage last fall. Ingersoll and Freed (through their attorneys, in coordination with the ACLU) sent a letter to the florist shop yesterday, saying she has two options: (1) She can vow to never again discriminate in her services for gay people, write an apology letter to be published in the Tri-City Herald, and contribute $5,000 to a local LGBT youth center, or (2) she can get sued a second time for violating the Washington State Civil Rights Act. Stutzman's lawyers argue that she is entitled to exercise her religious convictions and that arranging flowers is an act of personal expression; any demands or limitations on those expressive flower arrangements is a violation of right to free speech.

On September 24th Radiolab posted a new episode, The Fact of the Matter. It included a segment titled Yellow Rain. Radiolab's website says that it's "a detective story from the Cold War, about a mysterious substance that fell from the sky in Southeast Asia at the end of the Vietnam war." Robert Krulwich's interview with two of the segment's guests has prompted outrage at his treatment of them. One of the guests, writer Kao Kalia Yang, talked with Hyphen Magazine.

The University of Minnesota recently announced that its College of Education and Human Development has created a searchable online catalog of "open textbooks" that are reviewed by U of M faculty. The books must be Openly Licensed, complete (not a draft version of the text, or a collection of lecture notes), suitable for use outside of the author's institution, and available in print for a reasonable price, generally less than $40 USD. This site differs from other collections of open textbooks in that it is developed and supported by a well known and respected university. University of Minnesota faculty will be paid $500 to write a review of an open-source textbook, the same amount they earn to adopt such a book in class. Related, previously: * Boundless Learning, an attempt at simulating required textbooks through various open texts, is being sued by 3 major publishers. * The Open College Textbook Act of 2009, which went nowhere.

Olivier Messiaen's Quartet for the End of Time is beautiful and strange. The approximately fifty minute piece was written and premiered in a Nazi prison camp, having grown out of the composers friendship with musicians he met while imprisoned. Of course, it is on youtube. In 2002 a Mrs. Soile Tuulikki Lautsi, a Finnish/Italian woman and member of the Italian Union of Atheists, Agnostics and Rationalists objected to the crucifixes on the wall of her child’s public school. Failing to win their removal through Italian courts, she sued in the European Court of Human Rights, claiming it violated European Convention on Human Rights. In 2009, she won. Some were dismayed. Italy appealed. In March 2011, the court’s Grand Chamber reversed that ruling in a unanimous vote(pdf). Some were dismayed. The decision is final. There are further links here for those interested in the legal arguments on both sides. (For those who simply enjoy good prose, I recommend the concurring decision (pdf), by Judge Bonello of Malta.) Americans gear up for this kind of suit every Christmas, but the European venue naturally brings out other flavors. Consider these observations from Lithuania. A new documentary entitled "The Vanishing of the Bees", narrated by actress Ellen Page, begins showing on November 29th, 2010. "Honeybees have been mysteriously disappearing across the planet, literally vanishing from their hives. Known as Colony Collapse Disorder, this phenomenon has brought beekeepers to crisis in an industry responsible for producing apples, broccoli, watermelon, onions, cherries and a hundred other fruits and vegetables. Commercial honeybee operations pollinate crops that make up one out of every three bites of food on our tables. Vanishing of the Bees follows commercial beekeepers David Hackenberg and Dave Mendes as they strive to keep their bees healthy and fulfill pollination contracts across the U.S. The film explores the struggles they face as the two friends plead their case on Capital Hill and travel across the Pacific Ocean in the quest to protect their honeybees. Filming across the US, in Europe, Australia and Asia, this documentary examines the alarming disappearance of honeybees and the greater meaning it holds about the relationship between mankind and mother earth. Last Sunday at Atlantic City's Boardwalk Hall, they paid tribute to Little Feat's 1978 live album Waiting for Columbus. "Phish are repaying," David Fricke says in his Phishbill essay [pdf] "a lifelong debt to the band that has inspired and influenced them above all others." Saturday night was dedicated to an elaborate Led Zepplin trick, weaving Whole Lotta Love, Heartbreaker, Ramble On, and Stairway to Heaven in and out of Tweezer.
