Today, on the last day of this year's term, the Supreme Court of the United States issued its opinion in Ricci v. DeStefano, the latest in the Court's line of decisions on Title VII and the role of race in employment decisions. The famous case centers on white firefighters' claims of race discrimination following the town of New Haven's decision to scuttle a promotion exam after white test takers performed disproportionately better than black firefighters. The case has been covered extensively in blogs and the mainstream and local media. In addition to the high-stakes questions at issue in the case itself, Supreme Court nominee Sonia Sotomayor sat on the panel of the U.S. Court of Appeals for the Second Circuit that summarily decided the case at the intermediate appellate level.

Don't shoot a man when he's down?

In a case reminiscent of Bernard Goetz, pharmacist Jerome Ersland was held up by two gun-wielding men, shot one of them in the head, and then, when the other had left, shot the prone man several more times, killing him (store security video). Now he's being charged with first-degree murder, and is the center of intense controversy about whether he engaged in legitimate self-defense by making absolutely sure his attacker was incapacitated or in an unjustifiable vigilante-style execution. Complicating matters is the fact that Jerome is white and the robbers black.

"Almighty God created the races white, black, yellow, malay and red, and he placed them on separate continents. And but for the interference with his arrangement there would be no cause for such marriages. The fact that he separated the races shows that he did not intend for the races to mix." Thankfully, the Supreme Court disagreed, on June 12, 1967. Happy Loving Day.

Taking the Long View

Only in 1967 did Loving v. Virginia overturn vigorously-enforced laws against interracial marriage in these 15 states--Alabama, Arkansas, Delaware, Florida, Georgia, Kentucky, Louisiana, Mississippi, Missouri, North Carolina, Oklahoma, South Carolina, Tennessee, Texas, Virginia, and West Virginia. Only in 1964 did the Civil Rights Act overturn laws against equal access to voting, public accommodation, and public education. Only in 1963 did the Equal Pay Act mandate that men and women be paid the same wage for the same work at the same job. History isn't a superhighway, leading us in straight lines toward utopia. We fall back and we move forward, but over the past fifty years, the United States has become considerably more inclusive and equality of access to opportunity has widened. More than half of all black men report that they have been the victims of racial profiling by police, according to a survey by The Washington Post, the Henry J. Kaiser Family Foundation and Harvard University.

Overwhelming majorities of blacks, Latinos and Asians also report they occasionally experience at least one of the following expressions of prejudice: poor service in stores or restaurants, disparaging comments, and encounters with people who clearly are frightened or suspicious of them because of their race or ethnicity. This is 2001?
