"Lawless Lands": Michael Riley, writing in the Denver Post, investigates the dysfunctional state of law enforcement on Native American reservations, and the shocking consequences for crime victims. Bill Moyer's Journal has followed up with an excellent documentary expose entitled "Broken Justice." Amnesty International reports on a particularly heinous aspect of the problem -- one in three Native women will be raped in her lifetime, and the perpetrators are rarely punished. N. Texas executes Mexican national who was denied consul visit. Jose Medellin, a Mexican national, was born in the border town of Nuevo Laredo, just across the Rio Grande river from Laredo,TX. Medellín moved to the US when he was 3 years of age, and was 18 years of age in June of 1993 when he participated in the gang rape and murder of Jennifer Ertman, 14 and Elizabeth Pena, 16 in Houston,Texas. He was subsequently found guilty and sentenced to death. In 2004, the International Court of Justice ruled that the Bush Administration must reconsider the case because Medellin was not informed of his right to contact Mexican consulate officials under the Vienna Convention. After the ruling, President Bush asserted authority under the Constitution and the various laws of the United States to order states to review the convictions and sentences of foreign nationals who had not been advised of their Vienna Convention rights. On March 25, 2008, the U.S. Supreme Court rejected the arguments of the Bush Administration, and ruled that President Bush can't force Texas to reconsider, even if in violation of the International Court of Justice.[Previously]

Hooker raped & robbed by justice system. Apparently, if you're a prostitute and you're gang-raped at gunpoint, that's not actually rape, but "theft of services". In Philadelphia, judge Teresa Carr Deni ruled exactly that in a case where a woman posted a Craigslist ad offering sex for money -- but when she met with her John, instead of the agreed upon exhange, he pulled a gun on her, raped her, then invited four other men to rape her as well. As if this weren't sad enough, a near-identical case -- with the same defendant -- came up four days later, and the prosecutor decided not to even try it as to not put the woman through the misery of being so resoundly denied justice. Devolution is real, spuds.

Judge bans the word "rape" from a rape trial. Jeffre Cheuvront, a Nebraska judge, "granted a motion by defense attorneys barring the use of the words rape, sexual assault, victim, assailant, and sexual assault kit from the trial of Pamir Safi—accused of raping Tory Bowen in October 2004." This move follows some tightening of language during trials meant to avoid unnecessarily swaying jury members. But has it gone too far this time?

Former University of Pennsylvania professor and head of Penn's Head Injury Research Center Tracy McIntosh, a Fulbright scholar, and renowned researcher plead no contest in December to possession of a controlled substance and the sexual assault of a 25 year-old Penn student. Judge Rayford Means sentenced him to a year of house arrest and 12 years' probation, as the Judge had "factored in McIntosh's important work with stroke victims and brain injuries."

Tracy McIntosh is too important for prison.

Child Molestation? Marcus Dixon, an 18-year-old Black high school honor student was recently convicted of child molestation, has been permanently expelled from high school, and is now serving 15 years in the George state prison for having consensual sex with a 15-year-old White girl. Even though he was acquitted of all forcible rape charges, the child molestation charge still earned him the long sentence. Racism? Mandatory minimums strike again?
