News is breaking that the New York Senate will pass marriage equality legislation today, despite media reports that the legislative push was "stalled" from as late as last week. (The State Assembly repassed the same bill shortly after midnight last night to facilitate the Senate's vote today.) This has all happened largely under the radar—though Markos "Daily Kos" Moulitsas was apparently in the know, hinting at this "big news" in his Twitter feed on Monday night. Today he writes: "So by the end of the week, gay marriage should be legal in New York. And there are no citizen initiatives in NY to overturn it."

It's more of a "how are you paying?" than "what are you doing?" kind of business. Square Inc. is a new startup cofounded by Jack Dorsey of Twitter and Jim McKelvey which will allow businesses and individuals to take credit card payments from customers anywhere. Receipts and confirmations are paperless and get sent to buyers via text message or email. While the media believes it is set to shake up the credit card processing industry, it has also committed to donate a penny on every transaction a merchant takes to a cause of their choice. Square is starting business with $10 million in venture capital funding and is of course tweeting the process; you can see it in action here or try it at Sightglass Coffee in San Francisco.

Roger Avary, Oscar-winning screenwriter for Pulp Fiction and many other films, pled guilty to gross vehicular manslaughter and drunken driving, following a crash that killed a passenger in his car in 2008. This September, he began to serve his sentence of one year in jail (followed by five years of probation). Naturally, he also began tweeting about it. The bleak literary quality of his tweets (in which he refers to himself only as "#34") caught the attention of Mark Millan at the LA Times -- and shortly thereafter, of the authorities. Avary had in fact been serving his time on a work-furlough program, spending nights and weekends in custody; he is now in jail full-time. (via)

A lot of us have had bad roommates. One man has taken it upon himself to chronicle the buffoonery of his meathead roommate, Steve, via Twitter. You can read about the loves of Steve's life, Slutty Tina and Burrito Girl. You can also get updates as to Steve's academic progress (or lack thereof). Finally, there is Steve's love of MMA, parties and drinking, and the bad decisions they cause him to make and not regret. Some choice tidbits: "Steve's Dad called to tell him that he can't use the emergency credit card to buy stuff from our Liquor Store or to buy Paintball supplies." "Steve's job for party tomorrow was drinks. Asked him why he didn't get mixers. "That'll be our THING. No Mixers!" Now I gotta go buy mixers" "Steve is sick. He keeps making jokes that he has swine flu and is purposely sneezing without covering his mouth. It's not funny." It's a fascinating look at the life of a total ass. Steve's roommate has somehow built a large following on Twitter, but Steve apparently doesn't know about it.

Michael Surtees latest photo experiment is called #walkingtoworktoday. The rules are simple and open to anyone—while walking to work take a photo. From there the photo needs to be pushed to Twitter via Flickr while containing the hashtag #walkingtoworktoday somewhere in the tile. But there wasn’t one dedicated space outside of Flickr to see the photos, and even then it was only seeing it through one medium—you didn’t get to see the tweets. So that’s why he decided there needed to be a site. Surtees created #walkingtoworktoday using Daylife tools that contained Flickr and Twitter moduals. The main modual streams photos from Flickr while the right rail shows the tweets. It’s an interesting redundancy that works.

Do not use "nonprofit" as an adjective. Use "broke."

One day ago, Neil Gaiman wrote the beginning of a story, which was retweeted by BBC Audiobooks America as the first of a thousand or so tweets that would compiled and edited to become an audiobook. People are still contributing, and BBCAA's blog has four scenes compiled (1, 2, 3, summary of scenes 1-3, and 4), for a total of 175 tweets. When 1,000 or so tweets are logged, they'll be edited into a script, and produced in a studio to make the final audiobook, which will be released for free on BBCAA's website. This isn't the first game of exquisite corpse played via twitter that made a piece to be refined and presented in some way. The first Twitter opera was one of a few recent "gimmicks" to garner attention for the Royal Opera House (twitter opera feed, ROH twitter feed, ROH blog). The result, Twitterdammerung, was given a decent review by opera critic Igor Toronyi-Lalic.

Vic Walczak, legal director for the Pennsylvania ACLU, sees the FBI's action as pure "intimidation," and part of a "much bigger war on demonstrators" in Pittsburgh. Elliot Madison was arrested by police on September 24 and charged with hindering apprehension or prosecution, criminal use of a communication facility and possession of instruments of crime. The Pennsylvania State Police said Madison was found in a hotel room with computers and police scanners while using the social-networking site Twitter to spread information about police movements. He has denied wrongdoing. According to Police who searched his home for more than 16 hours after the arrest, Madison was "directing others, specifically protesters of the G-20 summit, in order to avoid apprehension after a lawful order to disperse.”

High court serves first injunction via Twitter. British court served the notice against an unknown internet user, after ruling that the offending Twitter account, BlaneysBlarney, impersonated the Donal Blaney, owner of law firm Griffin Law, who has a blog in the same name. Called "Blaney's Blarney Order," it's named after the right-wing blogger who filed the complaint. From Blaney's blog: Today is a great day for the overwhelming majority of well-meaning, decent people who use the internet and a bad day for bullies. It is, as I have said in the media, the day the scales of justice were tipped back in favour of innocent victims. I am proud that my firm, Griffin Law, has set precedent and made law today. Blaney isn't the first person to take on rogue Twitter impersonators. Slate's Emily Bazelon has written on impersonation paranoia, and former Alaska governor Sarah Palin has tweeted on the problem (if you just want to stalk and don't want to impersonate, you can go here). UK law states that injunctions don't have to be served in person -- they can be delivered via fax or email as well. In this case, the twitter user will be notified the next time they log in. Read up on Twitter's impersonation policy, plus handy guideline for what to do if you are served with an injunction in Britain.

The Washington Post has issued new Social Media Guidelines for all employees. From the memo: "All Washington Post journalists relinquish some of the personal privileges of private citizens." Further: "Post journalists must refrain from writing, tweeting or posting anything—including photographs or video—that could be perceived as reflecting political, racial, sexist, religious or other bias or favoritism that could be used to tarnish our journalistic credibility." Staff writer Gene Weingarten had an inspired Tweet to mark the occasion.
