Huh? What do you mean tie-breaker? Nader's not even polling 4%!!

If in fact there is no decision by the electoral college, then the House of Representatives decides, on a basis of one vote per state. Given the number of states Bush has pulled in, it's easy sailing for him if this happens.

It's covered in Amendment 12, which supersedes the section in the main constitution covering the same thing.

Here's the interesting thing: in the unlikely event that there's a tie in the House, then the existing Vice President becomes President for the new term. Al Gore may have a chance yet.
