Miley Cyrus upskirt shot: Child porn?

"Miley Cyrus upskirt shot: Child porn?" "Blogger Perez Hilton posts a link to an alleged upskirt photo of the 17-year-old -- and could face serious charges." The photo in question has since been yanked down, but the image is allegedly of Cyrus climbing out of a car wearing a dress and no underwear. Censored up-skirt image.

More on Perez and up-skirt shots in this Guardian article: He pioneered upskirt shots. Can we pay a bigger tribute?

The article discusses whether or not Perez Hilton should be charged? Thinking the discussion would be more on the legality of taking action against him.

There's so many subjects in this post you could be referring to and the answer to all of them is probably not.

This is not a good post for MetaFilter.

Without actually wanting to take a stand on anything, I would like to point out that it strikes me as emblematic of something that a photograph that features the nudity of a minor is automatically child pornography. Are upskirt shots of adults automatically considered pornography?

While the subject matter is obviously sensational, the discussion about the legality of taking action against blogger Perez Hilton is pretty serious. I don't like him and I find Miley Cyrus to be another tart of the week but these issues do effect people.

that picture is not anatomically possible...photoshop.
does that affect the charges of kiddy porn, tho?

I think this whole thing is an attempt from Salon to get google hits ("Miley cyrus"+porn). I bet at least one or two twisted individuals has been searching that string every hour of every day for 4 years now.

This is a stupid post and it should be removed. Metafilter is too good for this low crap.

...as well as this are why I posted the links.

Another pop-star gone bad is not really the subject, we've all been there and done that. But the legal and ethical issues of this are something to discuss.

But the legal and ethical issues of this are something to discuss.

You have a fundamental misunderstanding of the way MetaFilter works.

If she can't afford underpants, Disney must not be paying her enough.

Won't someone please think of the children??

I think charges should be filed against her parents. When I was still in high school we were reminded to put on clean underwear daily in case we got in an accident. I don't see how this is any different. Further evidence of the erosion of vital parenting skills in this once-proud country.

Also, I'd like to be clear that despite the horrid economy, my wretched current state of employment and job prospects, and the general nightmarish depression about the next decade or so of American economic prosperity, I'm pretty much thankful as all hell that I do not have any career where my big problem of the day is whether or not I'm going to be arrested for the photograph of a 17-year-old celebrity's vagina I just posted on my website for which I make money to do things like, say, post photographs of celebrities' vaginas. Because I don't think there's an amount of money that exists in reality you could give me to make that my job and not have me feeling like I want to swallow a Glock at the end of whatever constitutes a work day in that field.

You have a fundamental misunderstanding of the way MetaFilter works.

Are you saying that discussing events that occur in the media that affect people ethically and legally are not worth discussing on metafilter?

Litmus test: Go downtown and candidly snap a few photos under several skirts. If her face turns red, there may be a correlation. If your are arrested in under 2 hours, I think you can safely refute the null hypothesis on this one, dude.

The fact that Perez Hilton is actually a public figure is a damning indictment of our culture.

I want to comment before it's ganked: If this is what it takes to get rid of Perez Hilton? GO FOR IT! OK. I've said my piece. Buh-bye, Perez.

Isn't this EXACTLY what happens at the end of the South Park episode about Britney Spears? The paparazzi slowly turn away from Spears' lifeless form, and spot their new prey, Miley Cyrus, and then shamble off to pursue her to the grave?
