Christopher “Moot” Poole, founder of 4chan, was testifying in the case U.S. v. Kernell regarding the hacking of Sarah Palin's Yahoo Mail account. moot had turned server logs over to the FBI that linked the Palin hack to Kernell, who was convicted of two felony counts.

The court steno also misspelled "white knight" as "white night." Makes you wonder how many errors are in court transcripts that you never notice.

Thinking more on it, I think the "rickrolling" line of question probably applies to the thread itself that is in evidence. Perhaps in the thread someone linked to Palin's "dox" but instead rickrolled his fellow 4channers. It would be logical, then, for both sides to want to clarify that the rickroll link is not the link under discussion in court.

Just shooting in the dark here.

What's confusing here is that the rickroll comes up on both direct and cross.

Maybe the crossing attorney put in the rickroll stuff to show that s/he, too, was familiar with 4chan's universe - in the cross, the attorney implies that s/he knows that rickrolling is a joke.

This is fairly interesting, in the sense that I had always wondered just how much information 4chan keeps as an entity. You have to assume that some amount of logging is simply built in by virtue of having an Apache server and so forth. At some level, it becomes more about actively deleting logs than trying to keep them.

In some theoretical, near-lawless data haven, how much would be kept? Would information be kept and simply not rendered to authorities when they demanded it? What materials would m00t decide were bannable offenses, if any?

We're reaching a point, with botnets, at which IP bans are getting a little less useful than they used to be, hence the recent implementation of reCaptcha on 4chan. With logs becoming less useful for site defense purposes, but presenting a legal liability, will site owners work harder to simply get rid of them?

Noooooooo, this does not count as a rickroll. One cannot be rickrolled on a meta level. The only way the attorneys could have properly rickrolled the judge or jury would have been through a demonstrative exhibit.
Periodically, I will have discussions with fellow lawyers about the required mens rea of a rickroll. Can one negligently or recklessly rickroll? I argue that negligent rickrolls count, while others argue that the severity of the offense (and the ideal appropriate punishment) requires the prosecution to prove a higher level of mens rea, such as knowingly or willfully.

Reading that, I'm almost more surprised by the things they didn't ask moot about, i.e. "pics or gtfo", "THIS Internet was serious business", "screenshits", "rapidshit", etc.

I guess if you have no idea what those mean, you're not focusing on them and assume they're typos or don't matter, but I can't help but feel like I've missed out on so many more dry explanations of Internet in-jokes.

Well, really, isn't that prime teenage geekerdom rebel without a cause age?

Weren't we all setting up BBS's or trying to get on to BBS's at that age? I imagine any kid doing that today would be doing, well, a website. Check out that TED talk, he speaks quite candidly as to how he started up the board just to have a US version of one he liked in JP. To have it become the center of the meme verse, though, that was just win.

Well technically you include both the content and an IP. The IP is what gets banned. There's a question as to how well IP-bans work, but that's a problem for pretty much any free website.

I'm not surprised you're confused; the mainstream media did an absolutely terrible job of reporting the story. But if you read enough sources from when it first broke, and before the real story was buried, you'd know that the biggest open secret in D.C. is that Sarah Palin is, and I'm not making this up, Rick Astley in a wig and some creative prosthetics.

Thinking more on it, I think the "rickrolling" line of question probably applies to the thread itself that is in evidence. Perhaps in the thread someone linked to Palin's "dox" but instead rickrolled his fellow 4channers. It would be logical, then, for both sides to want to clarify that the rickroll link is not the link under discussion in court.

I think this is pretty likely, actually. Alternately, the defendant might have rickrolled someone in the confession thread, meaning that it will be discussed when that evidence is presented.

Here's the 'confession', which explains most of the questions about vocabulary, but interestingly, Rickrolling isn't mentioned.

I suspect that in the thread where he (allegedly) announced his exploits, some other participants dismissed it as 'just a rickroll' or something along those lines. Normally I would try to find some evidence to confirm this theory and provide a link to it, but in this case everyone would assume I was rickrolling them, and my effort would be wasted. So it remains nothing more than a shrewd theoretical gambit on my part.

4chan has improved a lot - they actually moderate to remove child porn, there's no more loli or guro hentai, and the endless "nigger" chant is lowered to sporadic use instead of every page.

Still not a great place by any account, but I suspect parents won't see it as any -worse- than most random porn places one could wander onto the internet.

Two observations:
  • The authorities could have asked him to tell them the IP address of the person who posted the thread, but apparently they had already determined it via some other means. (I haven't been following this case closely; is it known how they got that IP in the first place?)
  • When moot said "The access logs are pruned regularly" earlier in his testimony, his definition of "regularly" allows him in February to still have logs from September. With 4chan's traffic volume, that kind of log retention policy requires a non-trivial amount of storage, so it really couldn't be a thoughtless oversight. For some reason, 4chan is intentionally keeping months of logs.
