Soon afterward, two F.B.I. agents visited Bernabei’s office and informed her that a classified document had accidentally been turned over to her. Bernabei told them that she had received only “unclassified” information, but she agreed to retrieve the document from her files. According to Bernabei, one of the agents suggested that as she looked for the document she should try not to think about what it contained.

If they had a reasonable belief that any telephone conversation with Seda or Buthi might be monitored by the N.S.A., could they talk to their clients without violating attorney-client confidentiality? Bernabei requested confirmation that the government was not intercepting her “written or oral communications” with her clients. Two weeks later, she received a response from the lawyers at the Justice Department. They wouldn’t confirm or deny.
It would be improper to comment on ongoing litigation.
