There will, of course, be appeals.

"Each challenge is independently meritorious, as Proposition 8 both unconstitutionally burdens the exercise of the fundamental right to marry and creates an irrational classification on the basis of sexual orientation." Federal judge Vaughn Walker has ruled that Proposition 8 is unconstitutional. Previously.

People are already talking about this coming just in time for mid-term elections, which they see as a downside, as this is a potential wedge issue. So, to clarify, in case my politicians get timid, this is a litmus test for me. I want you to clearly and unambiguously state your support for gay marriage, even if it costs you votes, because if you do not, it will cost you my vote, forever. Those of us who support gay marriage are in the majority, and it is time you started pandering to us, rather than the bigots.

I would be happy to celebrate this ten - twenty times... You could fill the front page with links to this if you wanted ... but then the discussion gets all broken up and hard to follow.

Do we really need to bifurcate the discussion with two FPPs? It's difficult enough following the lengthy one already in progress.

So the "but gays are ooky!" defense didn't fly after all, huh?

We'll see what happens when this inevitably winds up at the Supreme Court, but hey, a win is a win.

Also, kudos to Ted Olsen, an otherwise unlikeable right-wing uber-insider, for acting on what seem to be actual principles.

There already is in-depth discussion, analysis and updates regarding the Prop8 ruling already in progress in this morning's FPP [208 comments and climbing]. I suggest we focus our efforts there.

Does this mean same sex marriage licenses can immediately be issued in California, or does that have to wait until appeals are exhausted?
