Oregon man says brain tumor caused him to jump in neighbor's bed Although Jackson County has paid nearly $150,000 for surgery and medical treatments, the Judge said "I do not find adequate evidence of mental defect," There are many examples of persons who may have acquired sociopathic personalities due to pathological brain lesions, such as tumors, yet no doctor testified to the tumor's effect at the trial. Poor lawyering?

Hm. Well, if you're basing your defense on a medical pretext, it'd probably be a good idea to call a doctor as a witness.

Do I pass the bar?

While the brain tumor defense was very nice...

Vandergaw pointed out that Smith was asking the woman for sex, but didn't jump on her or touch her.

"It's no crime to ask," Vandergaw said.

I think that argument was even more ingenious. Woah.

"He now realizes since he had the tumor removed from his brain it was all wrong."

Altogether an elegant defence.

This is interesting. My wife wrote the original story from which this AP account was adapted. Unfortunately, I can't link to her story -- much better written, of course :) -- because for some reason my paper's Web site doesn't have it. sigh. But here's an earlier story she did on how much the guy's brain tumor was costing the county.
