Not knowing what really happened. Was the soup tested for "human secretion"?
Also, if the waiter is guilty and it was only a condom, how much compensation would she be entitled besides an apology? The way the article is worded she assumed the condom contained cum.

And, wouldn't the rude waiter be the obvious choice after finding a condom in your soup; so why would he do it? With the laws today, seems you would be convicted of a sex act.
