*heh* nice job. Pointing out that Beck himself blew up the meme larger than it had been before, and then after proving his case in court, just holding out his hand and saying "here, take it". It proves he's the bigger person all around, and forces Beck's hand about taking ownership of a domain name which posits dark and secret happenings in his past.

Between this and Stewart's spot-on lampooning of Beck on TDS last night, I'm feeling all warm and fuzzy, like an anti-Beck snuggie has just been wrapped around me, leaving my arms still free to type this comment.

Ha, I just watched last night's Daily Show so I too am wrapped in a nice warm anti-Beck snuggie, or slanket, if you prefer. If this keeps up I may be able to permanently forget that people actually take the guy seriously.

I appreciate the guy's move, but the 1st Amendment thing is... odd. This isn't a 1st Amendment case - we're talking about civil actions between two private parties. When people start screaming "FIRST AMENDMENT" when it doesn't apply really irritates the hell out of me.

You are 100% wrong. It applied in this case to the extent Beck was asserting a defamation-like claim. Read the brief linked in the prior post.

I wonder if Glenn Beck will actually start paying hosting fees for this domain or if he'll let it slide into the hands of some domain squatter who puts nasty porno ads on it. Either way, Beck loses. He's either gonna have to pay money for nothing or have his name associated with something else he doesn't like.

glennbeckrapedandmurderedayounggirlin1990.com, is confusingly similar to the GLENN BECK trademark and service mark. Respondent argues that only a “moron in a hurry” would find the disputed domain name and the mark confusingly similar.

In the Panel’s view.... [e]ven a “moron in a hurry” would not likely conclude that Complainant sponsored, endorsed or was affiliated with the website addressed by the disputed domain name....

I'm not particularly sure how to take the site Domain Name Wire as my only resource on this story - granted the owners seem to be up front about posting that they own stock (tho don't say where) Are there any other places I can follow this story? (Still looking through links in the other thread - and I'm not really looking to read either side's blogs.) Some of the legal newsish sites I would have expected to see posts about this are either slow to publish something or I've missed it. Maybe it's a weekend thing? Or still filed as "internet craziness" in other "serious" media?

I find Beck immensely entertaining. I'm a fan. The usual thuggish right-wing TV and Internet personalities are deeply unimaginative -- Hannity, O'Reilly, Coulter, Malkin are just grim, obnoxious, predictable bullies. They bore me. I once listened to quite a bit of Limbaugh back in the early Clinton years, back when he was relevant, and he was, again, just a cheap bully, on autopilot, I just could predict what he was going to say on any given topic, more or less (I admit I was later surprised that he had the balls to actually mock poor Michael J. Fox for his Parkinsons, I didn't think Limbaugh was _that_ depraved).

Beck, on the other hand, is the Jack Kerouac of right wing punditry, he's the Beat poet of American Fascism -- I'm fascinated by his riffs, bewitched by his insanity. I'm a big, big fan. And I really couldn't be farther away from his politics and worldview.

batgrlHG you can always read the original rulings on the WIPO site. I can understand being blog adverse if you doubted the facts, but they seem pretty laid out here. You get the initial complaints, the responses, and the ruling.

matteo, that sentiment isn't totally foreign to me: I actually find Fred Phelps fascinating as a performer when I listen to some of his sermons.

But I haven't heard the right notes from Beck yet. Maybe I just don't have the taste. Or haven't been able to make myself watch long enough. Can you point out anything in particular that's struck you?

Nah, not so much that - when I go read what I think of as a news story on something blogish, then I feel I have to look for the opposing side's blog (especially in a legal case) - as opposed to just reading multiple news site sources to try to get a handle on coverage and how a story's being reported. I'm more thrown that this isn't popping into the, you know "real" news sites, but I guess everyone's thinking of it as "those goofy kids and their internets jokes." Or maybe now there's a popular habit of not taking Glen Beck seriously? I mean, there are some legit legal issues pertaining to satire here. Seeing how popular such satire as Jon Stewart and Stephen Colbert are, I'd sort of thought this would get more notice in other types of media.
